DPP appeals ex-AusAid adviser’s child porn sentence

The ACT Director of Public Prosecutions (DPP) says a full custodial sentence must be imposed on a former senior AusAid adviser for possessing child pornography.

John Dunbar Fowler, 60, was appointed a member of the Order of Australia for his work overseeing the construction of the new Parliament House.

Fowler was running for international vice-president of the Lions Club when he was arrested in 2005.

Last June, Fowler was sentenced to 12 months’ periodic detention after police found about 200,000 pornographic images on his computer, half of which were of children engaged in sexual acts.

Today the DPP appealed the sentence.

DPP Richard Refshauge told the Court of Appeal at least a few months of a full-time custodial sentence must be imposed.

The defence counsel argued Fowler had been sexually abused as a child and raised concerns there was a risk he would be brutalised if given a full-time custodial sentence.

Fowler has already served eight months of his sentence.

The full bench has reserved its decision.

Former AusAID adviser sentenced for child porn possession

A former senior AusAID adviser has been sentenced in the ACT Supreme Court to 12 months’ weekend detention for the possession of child pornography.

John Dunbar Fowler, 59, had been nominated for international vice-president of the community organisation Lions when he was arrested last year.

Today he told the court he has a strong belief in the protection of children, despite his actions.

In sentencing, Justice Ken Crispin said the gravity of the offences lies in the exploitation of children, and noted the devastating consequences Fowler’s actions had on his life.

Former AusAID adviser faces pornography charges

A Canberra man who was made a member of the Order of Australia and was recently employed as a senior adviser to AusAID has appeared in court on child pornography charges.

John Dunbar Fowler was arrested late last night and taken into custody.

This morning he was charged with one count of possessing child pornography and two counts of using the Internet to access child pornography.

The 58-year-old from Isabella Plains had been nominated for the the position of international vice president of the Lions Club.

He was made a member of the Order of Australia for his role in the construction industry which included work on Parliament House.

International development agency AusAID says Mr Fowler’s services have been suspended.

Mr Fowler did not enter a plea at today’s hearing.

He was released on bail and will appear again on June 21.

Jeffrey Wayne Fowler, 57, was sentenced to nine months jail but released on 18 months probation in Cairns District Court yesterday after pleading guilty to possessing child exploitation material and using the internet to access child porn.

Child porn ring busted

Among the images was a naked six month-old baby, a naked three-year-girl, a naked 11-year-old girl being penetrated by a man, cartoons showing children being smacked on the bottom and a video of a naked teenage girl in a bath.

There was also an image of someone stubbing out a cigarette on a girl’s tongue.

Commonwealth prosecutor Aaron Guilfoyle said Fowler told police he looked at the child porn sites and saved images but deleted everything because he did not want his wife to find out.

He said he used search terms such as “girls”, “preteen”, “teen sex” and “Lolita” to find the images.

Judge Sarah Bradley said she accepted Fowler did not pay for the images or distribute them, and also that 13 of the 15 most explicit and abusive images were actually cartoons.

“With cartoons there are no live victims but all the other images, of which there is over 350, did involve live, real children,” she said.

“Somewhere in the world, children, some in your case as young as a six-month-old baby, are being put into sexual poses, in sexual situations, in some cases actually penetrated and photographed.

“Clearly that sort of industry is abhorrent.”

AN Adelaide man caught hoarding child pornography by US authorities has been jailed for three years.

The District Court this morning ordered Stephen John Foster serve at least 18 months of that sentence before being eligible for parole.

Foster, 63, of Ethelton, pleaded guilty to aggravated dissemination and possession of child pornography.

His perverted collection of 19,100 images and 1060 videos was uncovered by the New Mexico branch of the Federal Bureau of Investigations during an online sting operation.

Foster unwittingly shared some of his haul with an FBI special agent in October 2010, leading to his arrest by SA Police in January this year.

In sentencing today, Judge Dean Clayton said most of Foster’s images and videos fell into the first two categories of child pornography, deemed to be the “less serious”.

Others, however, were of the highest category  which includes acts of bondage and bestiality.

“This is not a victimless crime,” Judge Clayton said.

“The production, possession and dissemination of child pornography leads to the abuse of many children around the world.”

He said Foster’s illicit hobby developed while he served as the primary carer for his aged parents.

“Your siblings hold you in high regard, saying you sacrificed a lot in selflessly taking on that role,” he said.

“But performing that role isolated you from normal social contact and you became reclusive, developing an interest in pornography five to six years ago.”

Prior to sentencing, Foster’s lawyer read a letter of apology to the court.

“(This is) a time in my life I’m ashamed of, and I’m sorry I didn’t have the sense to do (things) differently,” it said.

“I would like to put this sorry time behind me… and would like a chance to finally get my life back on track.”

Judge Clayton, however, said neither that contrition nor Foster’s previous good character warranted suspension of his sentence.

A MAN who downloaded about 19,000 images and videos of child porn is no risk to kids, a court has heard.

When Stephen John Foster, 63, of Ethelton, appeared in the District Court yesterday for sentencing submissions, his lawyer said his client was not “generally interested” in small children.

Foster had pleaded guilty to one aggravated count of disseminating child pornography and one aggravated count of possessing child pornography. The offences occurred in October 2010 and in January this year.

His arrest followed an international FBI sting on child exploitation, during which an agent based in New Mexico discovered Foster had shared 637 images online.

His home computer was later seized and 18,100 images and 1060 videos were found to have been downloaded.

Yesterday the court heard Foster used a file sharing program which enabled others to download some of his files.

For that reason, prosecutors said, there was no good reason to suspend a prison term.

But David Stokes, for Foster, asked that his client receive a suspended sentence or, at least, a minimal non-parole period.

“This man is not a risk to children, he’s not a risk to the community,” he said. “He’s caught out by the scale (of offending), he’s caught out by the number of images.”

Mr Stokes said his client had looked after both his parents in the years before they died.

“He’s a man who has enormous compassion for his family and others,” he said.

“It’s therefore perhaps a little odd that he would find himself in a position of downloading child pornography.”

Foster will appear before Judge Dean Clayton for sentencing next Tuesday.

A former hairdresser who sexually molested a 14-year-old girl at a cinema has been sentenced to two and a half years in jail.

Kimrae Fortaleza, 22, told the victim that she would “get used to the pain” as he forced his hand under her clothes and continued the assault despite the girl’s efforts to stop him.

The ACT Supreme Court heard that at the time of the offence in January 2010, Fortaleza was already on bail for more offences involving sex with underage girls in 2008 and 2009.

Fortaleza met the victim at a birthday party at the Phillip ice-skating rink and exchanged phone numbers with the girl, organising to meet up for a movie the next day.

The court heard Fortaleza then kissed the girl and touched her inappropriately during the movie, telling the girl he had lied about having a girlfriend and telling her she would get used to the pain of the assault.

Fortaleza pleaded guilty to one count of sexual intercourse with a child aged under 16.

He is already serving a prison sentence for the 2008 and 2009 charges of having sex with two other 14-year-old girls.

This morning Justice Hilary Penfold said the girl told of pain, ongoing difficulties at school and blunted emotions after the incident and said she felt dirty, weak and humiliated.

Justice Penfold said the earlier sex charges meant Fortaleza would have been aware that “the law frowned on” his actions when he molested the girl at the cinema and he still appeared to struggle with the idea that he had done anything wrong.

But she said he appeared to be genuinely remorseful about the impact of his actions on the victim and had empathy for the loneliness and hurt the girl had experienced.

Justice Penfold said reports tendered in court showed Fortaleza was significantly immature and had no grasp of sexual boundaries but was not a sexual predator.

She imposed a jail sentence of two and a half years, extending Fortaleza’s current prison term by 18 months to a total of eight years.

Fortaleza will be eligible for parole in August 2014.

A former hairdresser who sexually molested a 14-year-old girl at a Woden cinema continued the assault despite her pleas for him to stop, a court has heard.

Kimrae Fortaleza, 22, met the young girl at the Phillip pool in January last year and took the girl to see the special effects movie Avatar.

Halfway through the film he began touching and kissing her before forcing his hand up her skirt, resisting her attempts to pull his hand away.

The ACT Supreme Court heard yesterday the girl told Fortaleza he was hurting her and begged him to stop, saying she was 14 while he was 21 and had a girlfriend.

But Fortaleza simply replied, ”I lied,” and told the girl she would ”get used” to the pain of the assault.

Fortaleza is being sentenced after pleading guilty to one count of sexual intercourse with a child aged between 10 and 16.

He is already serving a prison term for sexually molesting two other girls, forming ”romantic relationships” with them when they were aged just 13 and 14.

He was already on bail for those offences when he molested the girl at Woden cinemas.

Fortaleza’s barrister Amanda Tonkin said her client was a naive, immature and unsophisticated young man who felt more comfortable with younger girls rather than women his own age, who were interested in nightclubs and partying. Ms Tonkin said Fortaleza did not recall the victim asking him to stop and did not realise she was unhappy with his sexual advances.

”He is a man who really has blurred sexual boundaries and … there is an absence of the sort of circumstances you might find where the complainant is encouraged to drink alcohol, to take drugs, is threatened, abused and the like,” she said.

”Mr Fortaleza simply took advantage of the complainant.”

But Crown prosecutor Kylie Weston-Scheuber argued that the gravity of the crime was increased because the victim was not consenting to the assault in any way.

She said the suggestion Fortaleza was naive was not borne out by the facts and it would have been clear to him from the previous sex charges that sexual activity with young girls was a serious offence.

Justice Hilary Penfold will hand down her sentence in February.

But the Crown told the court that Fortaleza was aware that he was committing a serious crime because he had been charged with the earlier offences and was on bail at the time.

Justice Hilary Penfold will hand down her sentence in February.

A man who sexually assaulted a 14-year-old during a movie date told the girl that she would ”get used to” the pain he was causing her, a court has heard.

He is already serving a six-year jail term for sexually abusing two other young girls after forming ”romantic” relationships when they were aged just 13 and 14.

The court heard Fortaleza met the victim in January last year and they went to see a film at Woden.

During the movie, he touched the girl’s thigh and put his hand up her skirt before kissing her.

Fortaleza then forced his fingers up the teenager’s skirt, ignoring her attempts to pull him away.

When she told him to stop as he was hurting her, Fortaleza said she would get used to it.

The court heard the girl was ”shocked or frozen” when she left the cinema with Fortaleza after the movie but broke down later when she met a friend and told him something bad happened to her.

Yesterday the court heard Fortaleza had shown remorse.

The author of a pre-sentence report told the court that Fortaleza, a former hairdresser, came across as ”somewhat humbled”.

She said Fortaleza appeared genuinely remorseful for the isolation and loneliness that his victim felt after the sexual assault.

But she added the young man was immature and unable to empathise with the victim or realise that his actions had caused the teenager’s suffering.

The court heard Fortaleza did not appear to understand boundaries for appropriate sexual behaviour around underage girls.

The report author said the man was keen to participate in an adult sex offenders’ program in jail but agreed in cross-examination that Fortaleza wanted to finish the program so he could apply for a transitional release scheme at the jail.

Justice Hilary Penfold adjourned the sentencing hearing to later this month.

Man faces court over underage sex

A 20-year-old Canberra man has appeared in the ACT Magistrates Court accused of having sex with two underage girls.

Police arrested Kimrae Fortaleza last night after searching his Banks house and seizing a computer and digital camera.

He has been charged with two counts of sexual intercourse with a young person.

Police allege Fortaleza had sex with a 13-year-old girl and a 14-year-old girl on separate occasions this year.

Magistrate Maria Doogan granted Fortaleza bail on the condition he does not contact or approach the girls.

He will return to court later this month.

Jailed for sex absue of homeless youth

A MAN found guilty of sexually abusing a homeless teenage boy to satisfy his own desires was jailed for eight years today.

John Michael Forrest, 55, of Burton, was sentenced in the District Court after being found guilty in a trial without a jury of seven charges of unlawful sexual intercourse in January, 2004.

Sentencing Forrest, acting Judge Andrew Wilson told Forrest he had “very effectively, and to satisfy your own sexual desires, seduced your victim”.

Judge Wilson said the youth had spent time in a homeless shelter and was “vulnerable”.

“Your victim was an unwilling participant and must have been confused and frightened,” he said.

Judge Wilson said the offences were not out of character for Forrest, pointing out Forrest had been convicted of rape and indecent assault of a 12-and-a-half year-old boy in 1992.

Forrest received a suspended sentence for those crimes.

Judge Wilson ordered Forrest serve four-and-a-half years in jail for the latest offences before being eligible for parole.

UPDATE:  JULY 2017

Fordham will be released this week, after being deemed a serious danger to the community. A Brisbane Supreme Court judge made a supervision order and decided Fordham would be released on 39 conditions, including a ban on alcohol and illegal drug use. Justice Martin Daubney also banned him from any contact with children under 16, except with permission from Corrective Services. The order will expire in July 2027.

A 50-YEAR-OLD man whose house was set alight by the young boy he had forced into prostitution “lit the match” to his own fire, the Hervey Bay District Court heard yesterday.

Reginald Thomas Fordham was sentenced to six-and-a-half years in prison for maintaining a “disturbing and destructive” relationship with a 14-year-old boy, which will be served concurrently with a two-year sentence for indecent treatment of the child and an additional six months for repeatedly exposing himself to a 22-year-old woman.

Last April the victim, who by that time was 16, set fire to Fordham’s home.

It was only when he fronted court charged with arson that the sordid details of his and Fordham’s two-year relationship were revealed.

When reading out her decision Judge Leanne Clare told Fordham he had taken advantage of his victim and made him his “rent boy”.

“You picked him as a child you could buy,” Ms Clare said.

“From the moment he said he would be prepared to whip you for $50 you used him.

“You have preyed on him and corrupted him.”

The court heard that while penetration never occurred, the acts were sadomasochistic and at the highest end of “sexually deviant” behaviour.

It was also revealed that he had a long history of sex-related offences and had faced court on five counts of arson.

Ms Clare said Fordham’s behaviour had left the victim “degraded and shamed” and set him on a path to alcoholism and liver disease.

She said that, at 18, the victim was already showing signs of cirrhosis and that his addiction had stemmed from the “destructive period” in which the abuse occurred where Fordham traded alcohol, cigarettes and money for sexual favours.

“I don’t think it any coincidence that you lubricated him with alcohol,” she said.

“It seems to me he took it to get through whatever you had in store for him.”

While she conceded the victim may have consented to the behaviour Ms Clare said the experiences must have been “deeply disturbing” for a 14-year-old and that the case was a perfect example of why it was illegal for children to make decisions about sex before they were 16.

“He was too young,” Ms Clare said.

“That is why the law protects children under 16 regardless of their own consent.”

Fordham will be eligible for parole on January 29, 2014.

A JUDGE forced to detail sexual crimes of a ‘‘very terrible nature’’ by a former Hunter couple against their young children said yesterday he would have named them if he were able.

The couple were ‘‘fortunate’’ their names would never be made public because it would identify their children, a son, 12, and a daughter, 11, Judge Roy Ellis told Gosford District Court.

‘‘If I could have permitted the publication of these two people’s names, I would have, and it is only to protect the two children that the [couple] were fortunate enough to avoid publication,’’ he said.

But he rejected a suppression application by the couple’s accomplice, Bruce William Ford, 44, of Umina, who was sentenced to 21 years’ jail, with a minimum term of 15 years, for his part in an international child pornography network.

After recounting an abbreviated version of a 22-page statement of crimes committed against the children at a Central Coast location over more than six months in 2010, for the third time in a week as the three were sentenced, Judge Ellis yesterday indicated the cases had taken their toll.

‘‘After sentencing three of these offenders it is more and more difficult not to use inflammatory words,’’ he said. ‘‘I think the less I say about it, the better.

‘‘These are extremely serious and disgusting acts against children.

‘‘This offender, via the friendship formed with the parents, regularly and seriously sexually abused their two young children, but not only that, very actively incited another deviate in another country to commit other disgusting acts against young children.’’

Ford, who was jailed in 2001 for less serious child sex matters, incited a man in Britain to have sexual intercourse with his stepdaughter, 4, and stepson, 10.

Judge Ellis declined to read the full statement of facts in court yesterday, and noted they were filed and part of the public record.

‘‘Although why anyone would want to read it, I don’t know,’’ he said.

He reserved particular criticism for the former Hunter man after sentencing him to 21 years’ jail, with a minimum term of 15 years last week.

‘‘The man’s the father and he let all this happen,’’ Judge Ellis said.

The last words Ford heard as he was led from the court were by the children’s aunt, who had earlier run from the court as some of the crimes were being described.

‘‘You won’t touch another child, you sick, mental freak,’’ she said.

A New South Wales man involved in an international paedophile network has been jailed for a maximum 21 years.

Bruce Ford was arrested in 2010, along with a 31-year-old woman and her 51-year-old husband who have already received lengthy jail terms for sexually abusing their own children.

Gosford District Court heard the trio dominated an international network of parents who carried out depraved sex acts on the children, often streaming them live on the internet.

Ford, from Umina Beach on the Central Coast, will be eligible for parole in 15 years.

The Commander of the state’s Sex Crime Squad says a lengthy jail term reflects the seriousness of Ford’s actions.

Detective Superintendent John Kerlatec has welcomed the sentence.

“It’s a pleasing result for a long slog investigation that commenced nearly two years ago,” he says.

“And it certainly represents the seriousness that both the courts and the community see this crime.

“It’s a very serious crime when a young child is abused.

“Whether it’s in Australia or any part of the world, it’s a serious crime.”

A woman has been jailed for the systematic sexual abuse of her own children, including broadcasting live pictures of them to an international internet paedophile ring.

The 31-year-old was sentenced to a maximum 18 years in jail with a non-parole period of 13 years.

She, along with her 51-year-old husband and another man, was arrested in November 2010 and admitted to a series of charges relating to the sustained sexual abuse of the couple’s son and daughter, aged 12 and 11.

The trio dominated an international network of parents who carried out depraved sex acts on their children, often streaming them live on the internet.

Gosford District Court heard how the woman encouraged other parents within the ring to abuse their own children.

Judge Roy Ellis said this showed a casual attitude towards her children’s abuse and showed “an unfathomable level of depravity” which was “impossible to grasp”.

The judge told the court the mother was sexually abused as a child by her own family members and has since expressed a wish to be punished for the sake of her children.

He said she was groomed by her husband but was an active and willing participant to the abuse and has scarred her children for life.

Karen Lindley, spokeswoman for child advocacy group Bravehearts, says there are lessons to be learned from the case.

“[The woman] herself was a victim of sustained prolonged child sexual assault and it’s history repeating itself,” she said.

“We must break the cycle.”

The woman’s husband was sentenced to a minimum of 15 years behind bars over similar charges last week, and another man is due to be sentenced tomorrow.

The children remain under the care of the NSW Department of Family and Community Services.

THEY were the last words heard in court yesterday by a man who had just been jailed until at least 2025 for committing and filming depraved sexual crimes against his own two children.

‘‘You’re gonna die in there you sick bastard,’’ said his former sister-in-law, the children’s aunt, as the former Hunter man, 51, was led away.

‘‘I needed to say it,’’ she said outside Gosford District Court after the first of three sentencings in an international child pornography case linked to crimes in the United Kingdom, France, the Netherlands, Germany and the US.

The children’s mother and another man will be sentenced next week after pleading guilty to multiple child sex crimes.

People in court for unrelated matters were visibly upset as Judge Roy Ellis read an abbreviated description of sexual crimes against the children: a boy, 12, and girl, 11, by their parents and another man at a Central Coast location in 2010.

The children, now living in the Hunter Region, were left to grow up in a situation ‘‘worse than orphans’’ after ‘‘losing’’ their parents when they were sexually assaulted by them, and then ‘‘losing’’ them again when both were arrested in late 2010 and charged with multiple child sex and child pornography offences, Judge Ellis said.

The boy was filmed while shackled, gagged and humiliated; threatened with a whip if he did not commit sexual acts; tied up and blindfolded; fed Viagra, and made to commit degrading heterosexual and homosexual acts with the three adults, Judge Ellis said.

The girl was forced to commit sexual acts with her father and the other man and the crimes distributed to members of the child pornography network overseas.

‘‘Not satisfied with committing these perversions on his children, the offender then filmed the incidents and streamed them to others,’’ Judge Ellis said.

The acts represented an ‘‘unfathomable level of depravity’’ by a man who not only ‘‘appears to have been completely oblivious to the needs of his children’’, but ‘‘appears to be proud of his treatment of his children’’.

‘‘The offender, in a self-indulgent and pitiless way, robbed them of their innocence, their formative years and their family.’’

The judge rejected the children’s father’s claim of amnesia about the 2010 incidents, after a psychiatrist rejected the claim.

He was sentenced to a minimum 15 years’ jail, with his earliest release date in November 2025 after taking into account time already served.

A sex offender jailed for assaulting two girls in a school toilet cubicle has been ordered to spend more time behind bars for sexually abusing an eight-year-old girl.

Lance Foot, 29, was accused of sexually abusing the girl between April and June, 2004, and pleaded guilty to six charges.

Victorian County Court Judge Thomas Wodak jailed Foot on Friday for nine years and six months.

Judge Wodak said Foot posed a significant risk of reoffending and the community needed to be protected.

On one occasion Foot told his victim not to tell anyone what had occurred or he would kill her family, the court heard.

Foot pleaded guilty to one count of sexual penetration of a child under 16 and five counts of performing an indecent act in front of a child under 16.

Judge Wodak said Foot’s actions had a profound effect on the victim and her family, effects that would continue for some time.

Foot must serve six years and six months before being eligible for parole.

Foot was jailed for more than six years in 1999 after visiting the female toilets at a school and sexually assaulting two girls.

A NOTORIOUS pedophile who has been labelled an “out of control predator with no chance of rehabilitation” failed in appeals on convictions in two separate child sex trials, today.

Martin Francis Flynn has a long history of offending against children and was used as an example to support Queensland’s introduction of a blue card system to vet people wanting to coach junior sporting teams about 10 years ago.

In the District Court in Brisbane last January, Flynn, 40, was found guilty by a jury of maintaining a sexual relationship with a child and of two rapes. The offences involved the young son of a woman Flynn knew and were committed in the Burpengary area, on Brisbane’s northern fringe between 2003 and 2006.

In a separate trial in February last year, Flynn was found guilty of maintaining sexual relationship with a child, taking indecent photographs, procuring a sexual indecency by administering a drug and rape.

The majority of the offences involved a boy and his sister, again the children of a woman friend, who lived in a north Brisbane suburb.

His sentence for those offences was adjourned until the second trial was resolved and Flynn had spent almost three years remanded in custody.

After serving 18 months, Flynn was freed and moved to Queensland where he again took up cricket coaching and eventually became vice-president of a Brisbane junior cricket club.

Ms Balic said Flynn used his position as a coach to molest the younger brother of one of his players. After a jury found him guilty, he was jailed for four years in 1999.

On his release, Ms Balic said Flynn cultivated two boys by becoming friendly with their single mothers – all this despite being a “reportable sex offender”.

She detailed how Flynn raped one boy twice and drugged the other lad before assaulting him and taking an indecent photograph of him.

Judge Tony Rafter, SC, sentenced Flynn to a total of 15 years jail.

Flynn appealed his first conviction for the 2009 trial on six grounds including his convictions were a miscarriage of justice.

He also appealed his second trial convictions on the grounds they were unreasonable and the judge misdirected the jury.

In an unanimous judgment the Court of Appeal dismissed the appeals.

Flynn further appealed his sentence and that appeal was upheld but only in regards to varying the concurrent sentences on two of the charges but that did not change the overall 15 years jail sentence.

Prosecutor Dzenita Balic told the District Court in Brisbane that the public needed protection from Flynn’s deviant behaviour and asked for a life sentence.

“There is no prospect of his rehabilitation. He is a man who needs to be supervised for the rest of his life,” Ms Balic said.

Judge Tony Rafter, SC, said Flynn had manoeuvred his way into the trust of the children’s parents so he could set up situations for his sexual gratification. “You are an insidious individual and a serious danger to the community,” he said, before sentencing Flynn to 15 years.

A District Court jury in Brisbane on Friday night, found Flynn, 41, guilty of maintaining a sexual relationship with a child and two counts of rape.

The offences involved a boy, the son of a woman Flynn knew, and were committed on Brisbane’s northern fringe between 2003 and 2006.

Last year, another District Court jury in Brisbane found Flynn guilty of maintaining sexual relationship with a child, taking indecent photographs, procuring a sexual indecency by administering a drug, and rape.

The majority of the offences involved a boy and his sister, again the children of a woman friend, who lived in a north Brisbane suburb. They were committed in 2006 and 2007.

His sentence for those offences was adjourned until last week’s trial was resolved and Flynn has been held in custody on remand for almost three years.

In a brief mention hearing today, Judge Tony Rafter, SC, adjourned Flynn’s hearing for all outstanding sentences until Friday.

Flynn made headlines in 1999 when he was jailed for four years on child sex charges.

At the time a cricket coach, he was found guilty of molesting the younger brother of one of his players.

It was revealed at the time, that Flynn had also been a cricket coach in Melbourne where he was jailed in 1993 for molesting two boys _ a player and the player’s friend.

After serving 18 months of his Melbourne sentence, Flynn moved to Queensland where he again took up cricket coaching and eventually became vice-president of a Brisbane junior cricket club.

The court heard that at the time of his Melbourne offences Flynn was not an Australian Cricket Board coach but had qualified since arriving in Brisbane.

He is banned from any role as a junior sports coach under Queensland’s blue card system which bars anyone with a child sex conviction from being involved with teams or clubs.

Chaplain under fire over pedophile

VICTORIAN school children have been counselled for years by a chaplain who admits a confessed pedophile is one of his friends.

The convicted pedophile’s wife is also involved in school chaplain Mark Taranto’s Hope4Kids organisation.

Mr Taranto founded Hope4Kids and is chaplain at the Eastbourne and Mornington Park primary schools on the Mornington Peninsula.

He yesterday met the principals after the Herald Sun alerted them about Mr Taranto’s association with pedophile Adrian Cornelius Floris and Mr Floris’s wife, Lynn.

The principals said Mr Taranto volunteered not to work at the schools until the issue of his lapsed registration to work as a chaplain had been sorted out.

Chaplaincy Australia’s Mark Batemen said Mr Taranto’s registration had not been renewed as a result of having Mrs Floris as his referee. He said her husband’s pedophile convictions made her an unsuitable referee.

Mr Taranto has maintained his friendship with Adrian Floris despite Mr Floris pleading guilty in 2002 to eight charges of sexual penetration of a child under 16 and performing indecent acts with a child.

Mr Floris was sentenced to two years and 11 months in jail after the County Court was told he tried to persuade the male victim the sex should be “our little secret”.

He was last year ordered by County Court judge Michael McInerney to pay $145,000 compensation to the teenage boy he sexually abused from 1998 to 2000. Mr Floris, 61, was also fined $2000 in 1994 for indecently assaulting a teenage girl.

Lynn Floris was Mr Taranto’s referee when he applied to register as a chaplain.

Mr Taranto defended his continuing friendship with Adrian Floris.

“Part of the Christian faith is that we forgive people,” he said.

“I don’t condone what he’s done. I have made that very clear to him, but I will continue to be a friend.”

Mr Taranto said he could see no conflict of interest in him being friendly with a pedophile while running Hope4Kids and being a primary school chaplain.

He said Mr Floris played no role in Hope4Kids, and said Mrs Floris’s role was restricted to bookkeeping.

Mr Taranto said he had changed churches, that Mrs Floris was no longer his referee and that he was just waiting for the minister at his new church to agree to be his referee.

Mornington Park primary school principal Geoff Seeckts and Eastbourne primary school principal Stephen Wilkinson issued a joint statement to the Herald Sun yesterday.

“We want to emphasise that we conducted all the right checks before we accepted Mr Taranto to work in our school, including police checks and obtaining his Chaplaincy Australia registration.

“At no time did Mr Taranto ever work in our schools unless he was supervised by a teacher.

“The issue for us is that there may be inconsistencies about his Chaplaincy Australia registration.”

A CHURCH official who sexually abused a boy during religious services and in a spa at his home has been ordered to pay his victim $145,000.

Adrian Cornelius Floris claimed that the boy, who was 13 when he first started molesting him on Christmas Day in 1998, hounded him for sex.

The abuse lasted until January 2000. Floris told the boy it would be “our little secret”.

County Court judge Michael McInerney yesterday awarded the victim, who cannot be named, $145,000 compensation for pain and suffering, medical costs, future economic loss and in aggravated damages.

Now rebuilding his life interstate, the young man told The Age that the abuse, Floris’ total lack of remorse and his long fight for justice had taken a heavy toll.

“I was shattered,” he said. “It felt like it was my fault. He didn’t have any remorse at all and he twisted it around so I thought it was my fault.

“My way of dealing with the trauma has been to keep myself very busy. In years 11 and 12, I worked three jobs and went from an A student to a poor one. I also put on a lot of weight.

“I lost many of my friendships and my relationship with my parents suffered greatly. I didn’t trust anyone and I became a very hard person.

“Every time I entered a church I felt dirty. Leaving Melbourne has helped but I miss it terribly. I’m starting to put the pieces back again very slowly and I’m very, very pleased that the court case is finally over.”

The victim’s lawyer, Dr Vivian Waller, said no amount of money could bring the boy’s adolescence back but her client hoped the compensation would help him to move on.

When the assaults occurred, Floris was a travel agent and a property manager at the Harvest Christian Church in Dingley, where his wife was an ordained Assembly of God pastor.

Floris was also the head of stewards and property manager of the Bays Christian Church in Mornington, where some of the abuse occurred in the toilets during church services.

In 2002, he pleaded guilty in the County Court to four charges of indecent acts with a child under 16, and four counts of sexual penetration of a child under 16 and spent 18 months in prison.

‘Hounded for sex’ court claim

It was “simply improbable” that a boy, 13, hounded a pastor’s husband, 52, for sex, a court has heard.

Adrian Cornelius Floris yesterday pleaded guilty in the County Court to four counts of indecent acts with a child under 16, and four counts of sexual penetration of a child under 16.

The court heard that Floris was involved with the Harvest Christian Church in Dingley – where his wife was an ordained Assembly of God pastor – when he began sexually assaulting the boy on Christmas Day, 1998. The abuse lasted until January, 2000.

At a police interview, Floris, a self-employed travel agent, had admitted the acts, but claimed they were initiated by the boy who touched him “whenever he could and wherever he could”.

Prosecutor Rosemary Carlin said this was “simply improbable”. Floris, now 55, of Mornington, was granted bail. Judge John Hassett is expected to sentence him today. Floris faces a maximum 10 years’ jail on each charge.
