HIV child abuser free in months

AN HIV-positive Ipswich man who abused three teenage boys will serve one year behind bars.

Daryll Andrew Baker, 42, pleaded guilty at Ipswich District Court to 12 counts of indecent treatment of a child and one count of maintaining an unlawful relationship with a child.

Baker was not charged with spreading HIV because it was believed the acts he committed against his victims would not have put them at risk.

He was diagnosed HIV positive after the abuse of the boys took place.

During sentencing yesterday, the court heard Baker befriended one of his victims, who then introduced him to the other two boys.

All were aged between 14 and 15 years when the offences took place – over a period of about nine months in 2008.

Crown prosecutor Noel Needham said Baker exposed the boys to pornographic movies in addition to committing indecent acts against them.

The offences were committed at Goodna while Baker was working as a backhoe operator.

Baker pleaded guilty to charges including one count of maintaining a relationship with a child under 16, indecent treatment of a child aged under 16, indecent treatment by procuring an indecent act, indecent treatment by exposing a child to an indecent act, indecent treatment by permitting an indecent act, and indecent treatment by exposing a child to a pornographic film.

He was sentenced to three years jail, to be suspended after he serves one year.

Judge Deborah Richards deemed 195 days spent in pre-sentence custody be declared as time already served. Baker was also sentenced to three years probation.
