Elite college ‘covered up’ sexual abuse

ELITE private school Prince Alfred College called a student assembly to instigate a “cover-up” of “widespread sexual abuse” within its boarding house in the 1960s, court documents claim.

A man, 60, who is a victim of convicted paedophile Dean Rollo Bain, says the college’s own chaplain warned boys “not to speak” about their suffering – or even mention the abuse in conversations.

The man – who cannot be identified – is suing the college in the Supreme Court for unspecified damages.

He blames the school for exposing him to Bain, now 74, who was employed as a teacher at the time. Documents lodged with the court allege the college was “aware of the sexual abuse” against the then-12-year-old victim and instigated a cover-up.

“(The college’s) then-chaplain, Reverend Kyle Waters, spoke at a boarding house assembly,” the papers say.

“(He) told the assembled students in the school assembly hall not to speak to anyone of the events . . . nor talk about it generally.”

The documents claim the college “permitted Bain to remain as a house master when it ought to have known he was perpetrating widespread acts of sexual abuse against numerous boys in the boarding house”.

The document says the college then failed to support the victim after he reported the misconduct of Bain to school authorities when they “ought to have known that he had an (earlier) conviction for gross indecency in 1954”.

It alleges the college’s conduct has left the victim with feelings of “fault, shame, guilt and fear”.

The documents say the victim has since developed a post-traumatic stress disorder which was so severe it required electro-convulsive shock therapy, along with repeated treatment as an inpatient at several psychiatric hospitals.

In 2007, Bain was jailed for three years with a non-parole period of one year and is now serving a two-year, five-month jail term for abusing another PAC boarder, also during the 1960s.

In its statement of defence, the college says the claim is invalid because it does not comply with the Limitations of Actions Act.

It says that because the crimes occurred so long ago, the college is unable to ascertain whether it was possible to obtain details of Bain’s prior history and whether security checks took place.

It also says many of the college employees have since died, making a fair defence improbable.

Bain will be eligible for parole in June.

More jail for ex-boarding master over sex abuse

A former Prince Alfred College teacher has been jailed for molesting a student boarder in the 1960s, in a case which the court was told the school had been keen to play down.

Dean Rollo Bain, 73, was a boarding master at the Adelaide private boys’ school in 1962.

He pleaded guilty to four counts of indecent assault against a teenager.

The victim told the District Court he reported the abuse to the school, but it had not wanted any adverse publicity and had pressured him not to say anything.

In a statement, the school says it supports victims and now has stringent policies to deal with any such offences.

Bain was sentenced in 2007 for sexually abusing two other students of the school and released on parole.

A doctor’s report suggested Bain probably would not survive another period of imprisonment.

But Judge Paul Rice ordered him into custody to serve a jail sentence of two years and five months with a nine-month non-parole term.

Sex-crime teacher ‘forgot’ third victim

A TWICE-CONVICTED sex offender and former elite boys’ school teacher has admitted abusing a third student, but says he cannot remember the child.

Lawyers for Dean Rollo Bain today urged the District Court to impose a suspended sentence, saying their client has only “a 0.15 per cent” chance of reoffending.

“He has no recollection of the victim, but he has pleaded guilty after hearing the victim give evidence,” Shane Spence, for Bain, said.

“He does not remember the victim, but he apologises for putting him through what he did.”

Bain, 73, is a former Prince Alfred College teacher who has already completed a jail sentence for molesting two students in the 1960s.

He has yet to be sentenced for multiple sex acts performed on another boy during the same period.

That victim, now an adult, has previously told the court he felt “nothing but contempt” for Bain.

“He knew what he was doing and it was probably a game to him,” the victim said in April.

“If there was one single thing I could change in my life it would be never to have met him or to be conned into thinking what he did was natural.”

Bain was able to be prosecuted for his sex crimes after the statute of limitations for sex crimes was lifted in June, 2003.

Today, Ms Spence acknowledged her client’s guilty pleas came “very late” in procedings.

She said that was because Bain had thought the boy had made up the allegations, and was “in cahoots” with the earlier victims.

She tendered a psychiatric report that found Bain did not satisfy the criteria for paedophilia.

“The probability of his risk of reoffending is 0.15 per cent,” she said.

“That is just so minimal… there is no evidence before this court (to suggest) he has offended in the past 47 years.”

Judge Paul Rice remanded Bain on continuing bail for sentencing in September.

PSYCHOLOGISTS have yet to determine whether a twice-convicted multiple sex offender and former elite boys’ school teacher has “paedophilic tendencies”, a court has heard.

Dean Rollo Bain, 73, was scheduled to face sentencing submissions in the District Court today.

Before the hearing began, however, his counsel warned they would need another date in the future to discuss their client’s mentality.

“I’m not going to be able to finish my submissions today,” defence lawyer Shane Spence said.

“We’ve been waiting for a report from the Sexual Offenders Treatment and Assessment Program, regarding whether Bain should be confirmed as having pedophilic tendencies.

“We’ve had difficulty obtaining that report, and only received it yesterday, and it is being read by a psychologist now.”

The hearing did continue so the court could take evidence from Bain’s three character witnesses.

A FORMER private school teacher is facing a second prison sentence after pleading guilty to indecently assaulting a third former student.

Dean Rollo Bain, 73, is a former Prince Alfred College teacher who was previously convicted of molesting two boarders at the school in the 1960s.

He was jailed by District Court Judge Peter Herriman in December 2007 for three years and one month with a 12-month non-parole period.

At the time he could not be named because of the pending charges regarding Bain’s third victim.

Bain this year admitted molesting the third boy, and pleaded guilty to four more counts of indecent assault at Kent Town in 1961 and 1962.

Prosecutors dropped two further counts of indecent assault against Bain in February.

Today the victim, who cannot be named, read out his victim impact statement, but asked the court be closed to avoid embarrassment and stress.

After the 2007 sentencing, a previous victim of Bain, David Angel, said the “slow and debilitating” four-year court process had taken its toll.

But Mr Angel said the court ordeal had allowed him to face his “manipulative and aggressive” abuser in court four decades later.

“The memories of fear from my childhood did not subside with the passing of time, they actually got worse,” he said at the time.

Bain was able to be prosecuted for his sex crimes after the statute of limitations for sex crimes was lifted in June 2003.

District Court Judge Paul Rice was today due to hear further sentencing submissions but Bain’s lawyers sought an adjournment to obtain a pre-sentence report.

Bain will again front court in June for the remaining sentencing submissions.

    Know I don’t like this…. I know him… and he was known as having sex with young underage boys.. I was another victim he did not get reported for and that was certainly less than 47 years ago his lawyer refers to.. I was 16 then and it occured at his house where he was living at the time with another underaged boy 15.. now deceased..He also was well known visiting gay pick up places.. I put him in the same class as john simons and peter birk both now deceased pedaphiles and both charged also on many counts but died before court sentencing..Baine a past 5aa travel speaker I switched off to weekly..Hope you have changed your ways now Dean after age caught up with you… No sympathy here as a compensated church victim to another pedaphile rat..

    dean bain was abusive as is the college in the last ten years by its denial to assist victims of bain

    and the reabusive of the court system.
