Man jailed after child porn extradition

An Australian tried to hide in Cambodia after police seized a huge stash of child pornography from his Queensland home, a court has been told.

Robbie Neils Berry, 54, had almost 130,000 child abuse images, videos and stories in his house at Daintree, in far north Queensland, when police raided the property in November 2008, the Brisbane District Court was told on Friday.

During the raid, police seized 10 external computer hard drives and several CDs containing the offensive material.

The court was told the material featured children aged between one and 17, most of it in the lowest category of seriousness.

Commonwealth prosecutor Anthony Gett told the court Berry was in Thailand at the time of the raid, and that he subsequently made his way to Cambodia.

The court was told he emailed relatives saying he was aware police had seized “a stack of stuff that is illegal” from his home, and that he intended to hide out in Asia.

But in February 2009 he was arrested in the Cambodian capital of Phnom Penh, where he spent more than eight months in detention awaiting his extradition to Australia.

Berry was the first person to be extradited to Australia for prosecution under Commonwealth online child sex laws that came into effect in 2005.

When he arrived in Brisbane in October, he was charged with possessing child pornography, using a carriage service provider to access child pornography and using a carriage service provider to make child porn available.

He pleaded guilty to all charges on Friday.

The court was told his offending came to light after Australian Federal Police received a tip-off from police in Brazil, who had been searching the file sharing application eMule for illegal activity.

Berry’s internet provider address was identified as having transmitted child abuse files in July 2007.

Judge Tony Rafter sentenced Berry to two-and-a-half years’ jail, but ordered he be released immediately on a three-year good behaviour bond and two years’ probation.

Berry has already served almost 18 months in pre-sentence custody in Australia and Cambodia.

Extradited man faces child porn charges

AN Australian man extradited from Cambodia to face online child pornography charges has been committed to stand trial.

Robbie Neils Berry, 53, appeared in the Brisbane Magistrates Court this morning charged with possessing child pornography, using a carriage service provider to access child pornography, using a carriage service provider to make child porn available and unlawfully possessing a weapon.

No plea was entered and Mr Berry made no application for bail.

The court has previously been told he possessed 14 computer hard disk drives of child porn.

Australian Federal Police (AFP) officers executed a search warrant at the man’s home in Daintree, north Queensland, in November 2008.

Police arrested Mr Berry in the Cambodian capital of Phnom Penh in May after the Australian Government issued an urgent provisional arrest request to the Cambodian Government.

He was extradited from Cambodia in October.

AFP officers say he is the first person to be extradited to Australia for prosecution under commonwealth online child sex laws that came into effect in 2005.

The maximum penalty for these offences is 10 years’ jail.

Man remanded in custody over child porn

An Australian man extradited from Cambodia to face online child pornography offences has been remanded in custody.

Robbie Neils Berry appeared in the Brisbane Magistrates Court on Saturday morning charged with possessing child pornography material, using a carriage service provider to access child pornography, using a carriage service provider to make child porn available and unlawfully possessing a weapon.

The court heard he allegedly had 14 computer hard disk drives of child porn.

Australian Federal Police (AFP) officers executed a search warrant at the man’s home in Daintree, north Queensland, in November 2008.

Police arrested the 53-year-old in the Cambodian capital of Phnom Penh in May after the Australian government issued an urgent provisional arrest request to the Cambodian government.

He was extradited from Cambodia on Friday.

AFP officers on Friday said the 53-year-old was the first person to be extradited to Australia to be prosecuted under Commonwealth online child sex laws that came into effect in 2005.

Berry has been remanded in custody to reappear in court on November 13.

The maximum penalty for the offences is 10 years’ jail.

Child porn suspect arrested in Cambodia

An Australian man is awaiting extradition in a Cambodian prison after he was arrested over child pornography offences he allegedly committed in Queensland.

Police arrested Robbie Neils Berry, 53, in the capital Phnom Penh on Monday after the Australian government issued an urgent provisional arrest request to the Cambodian government, an Attorney-General’s Department statement said.

“Mr Berry is wanted for prosecution in Australia for child pornography offences,” the statement said.

“Australia will now finalise a full extradition request to Cambodia and as this is now a matter for Cambodian authorities, it is not appropriate to comment further.”

Sok Phal, Cambodian Deputy National Police Chief, said Berry appeared before Phnom Penh Municipal Court on Monday but was not charged with any offences in Cambodia.

“This arrest was made on the request of the Australian government and so far we have not found any evidence that he committed crimes in Cambodia,” he said.

“But we have begun an investigation and will charge him if we find evidence of wrongdoing in Cambodia.”

Sok Kalyan, Cambodian Deputy Chief Prosecutor, said the charges related to child pornography offences allegedly committed in Queensland.

“We do not know when these offences occurred and we do not know for certain when Mr Berry arrived in Cambodia,” he said.

Sok Kalyan said Berry would be detained in a police prison in the capital until the extradition procedures were completed.
