Child porn appeal ends in jail time

STUNNED family and friends looked on as a Corio man appealing a four-month jail sentence on child pornography charges was jailed yesterday.

Daryl Blackman, 44, of Corangamite Drive, pleaded guilty in Geelong Magistrates’ Court in June to five counts of possessing child pornography.

He was convicted and sentenced to four months’ jail before lodging an appeal against sentence.

During the appeal hearing in Geelong County Court yesterday, Crown prosecutor Paul Stefanovic said that in December, 2006, Australian Federal Police received a referral from German police about Australians who were among 238,937 people who had used a legitimate website to download child pornography.

Mr Stefanovic said one of the Australian suspects who used the names of ‘Chris the Rock’ and ‘Spiderman 249′.

The prosecutor said a search of Blackman’s home in January this year found three computer hard drives and assorted DVDs.

He said analysis of the items revealed 65 video files and 42 images showing males ranging in age from about 12 to 18 years taking part in sexually explicit acts.

Brendan James, for Blackman, said his client was under no illusion as to the seriousness of the charges, but had made admissions and been co-operative with police.

“He is embarrassed, humiliated and deeply remorseful of his actions,” he said.

Mr James submitted the volume of material found in Blackman’s possession was not extensive and the level of depravity, although lewd and vulgar, was at the lower end of the scale.

He said Blackman, a father of two, had been married for 22 years, was a good worker and had no prior convictions.

Judge David Morrow accepted Mr James’ submissions along with a psychiatrist’s report stating that it was unlikely Blackman would re-offend.

“No doubt it has caused you great embarrassment and humiliation and I accept that jail may affect you and your family but general deterrence is of the utmost importance,” he told Blackman.

Judge Morrow sentenced Blackman to four months’ jail with one month to serve immediately and the remainder suspended for two years.

Corio man gets four months’ jail for child porn

A 44-YEAR-OLD Corio man, sentenced to four months’ jail for possessing child pornography, was back on the streets last night after being granted appeal bail.

Daryl Blackman, of Corangamite Drive, pleaded guilty in Geelong Magistrates’ Court yesterday to five counts of possessing child pornography.

Police prosecutor Sen-Constable Geoff Lamb said Australian Federal Police received a referral from Interpol in Germany in December, 2006, relating to several Australian suspects involved in child pornography.

Sen-Constable Lamb said the tip-off came after the owner of a legitimate website complained to German police that his site was being misused for the exchange of child pornography.

Sen-Constable Lamb said police executed a search warrant on Blackman’s home on January 18 this year and seized three computer hard-drives and other computer equipment.

He said forensic examination of the items revealed 100 images of child pornography, some containing images of pre-and pubescent males.

“The defendant admitted accessing the websites and downloading several images to his computer and said he began doing this in 2006,” the prosecutor said.

Brendan James, for Blackman, said his client was under no illusion of the seriousness of his offending but asked the court to allow him to serve any custodial sentence in the community.

Mr James said the possession of 100 images was far lower than most and there was no suggestion his client had paid for any of the material.

“He has pleaded guilty, is embarrassed, anxious and remorseful and has otherwise led a blameless life,” Mr James said.

Sen-Constable Lamb said one image of child pornography was one too many as the children were violated.

Magistrate Tim McDonald told Blackman that without people like him, the child pornography industry would not exist. He ordered Blackman be placed on the sex offenders register.

Blackman was later bailed pending an appeal against sentence.
