Man sentenced over child sexual assault

Townsville Bulletin – 15/08/2008 – Page 14

A MAN made a brazen sexual assault on a six-year-old girl when she answered the

door of her Ayr home last October, a Townsville District Court was told

yesterday.

Donald Samuel Boota, 38, pleaded guilty to a charge of indecent treatment of a

child under 12 when he appeared before Judge Bob Pack for sentencing.

Crown prosecutor Josh Phillips said on October 4 last year, Boota had gone a

house in Ayr and his knock on the door was answered by a six-year-old girl.

Boota beckoned her out to where he was sitting on the steps.

Mr Phillips said he then stroked her genital area on the outside of her pyjamas

and asked the girl, `Are you awake down there?’.

The girl ran inside and told her mother what had happened, Boota fled but was

located the next day.

He denied the child’s charge and said he had gone to sell a man some fish, but

Mr Phillip’s said he was barely known by the child’s parents.

Judge Pack jailed Boota for two years.

However, noting that the 244 days Boota had already spent in jail awaiting

sentence was about a third of the term, he directed that the prisoner be

released immediately on probation.

The 16-month remainder of the sentence was suspended for two years.
