Man jailed for sex with three boys

A MELBOURNE man who had sex with three 14-year-old boys after meeting one of them on an internet chatroom has been jailed for five years.

Ryan Birdseye, 27, met the first of the boys on the chat site in September last year, telling him he was 19.

After chatting to the boy online for a few weeks he invited him to his Narre Warren South home where they performed oral sex on each other, the Victorian County Court heard today.

Birdseye told the boy he “loved” him, the court heard.

But the relationship ended after the boy found out Birdseye was sending text messages to a friend of his.

Birdseye also spoke to the second boy on the internet, before having oral sex with him, the court heard.

He had oral sex with a third boy after getting his phone number from one of the other boys.

Birdseye pleaded guilty to 13 counts of sexually penetrating a child under 16 between September 2009 and February this year.

Sentencing Birdseye, Judge Jane Campton said his offending had caused significant distress to the boys and their families.

“You had sex with three boys that you knew were only 14,” Judge Campton said.

“The fact that you were grappling with the issue of your sexuality and that you were immature does not constitute an exceptional circumstance.”

At a pre-sentence hearing last month, Birdseye’s barrister Peter Chadwick argued his client should be spared prison because he had a developmental age much lower than his actual age, closer to that of his victims.

The court at the pre-sentence hearing was told Birdseye dressed like a teenager and watched television programs aimed at young people.

Today Judge Campton said people needed to be deterred from using chatrooms to arrange sex with children.

“It is obvious that your offending has caused significant distress to both your victims and their families and it may have a detrimental affect on them in the future,” she said.

Judge Campton jailed Birdseye for five years and ordered he serve two-and-a-half years before being eligible for parole.

He will be a registered sex offender for life.
