Govt appeal fails to jail child sex offender

An appeal launched by the Queensland Attorney-General has failed to have a high-profile Noosa businessman jailed for procuring a fictitious 13-year-old girl for sex through the Internet.

In March this year, 51-year-old Frederick John Burdon pleaded guilty to using the Internet to procure and expose a child to indecent acts.

He was handed 18-months in prison, wholly suspended and ordered to complete 240 hours of community service.

Today, lawyers acting on behalf of the Attorney-General argued the sentence was manifestly inadequate and Burdon should serve three of his 18-month sentence in prison.

Burdon’s barrister argued the original sentence was within range and his client committed what was essentially a victimless crime, because a police officer was posing as the 13-year-old girl.

Three Court of Appeal Justices agreed the sentence was in range and dismissed the application.

Businessman gets suspended sentence over child sex charge

A high profile Sunshine Coast businessman has avoided a jail term after pleading guilty to using the Internet to procure a child for sex.

Last April, police arrested Frederick John Burdon, 51, at a fast food restaurant in Brisbane after he had organised through an online chatroom to meet a 13-year-old girl, who was actually a police officer.

The Noosa man pleaded guilty in the District Court to one charge of using the Internet to procure a child to engage in a sexual act and another charge of using the Internet to expose a child to indecent matter.

The former chamber of commerce and Rotary club president was jailed for 18 months, wholly suspended.

He must also complete 240 hours of community service.
