Day has been found dead. After he left the Freedom Centre, he went back to using his first name Craig and was last living at Bilton Lodge in Claremont.



60yo man who produced child pornography avoids more jail time

A 60-year-old man who produced child exploitation material while serving time in Hobart’s Risdon Prison has avoided more time in jail.

Sonny Day was in Hobart’s Risdon Prison between December 2010 and June 2013, serving a sentence for a series of crimes relating to child pornography.

Day pleaded guilty to three counts of producing child exploitation material.

On 21 May 2012, jail staff found that he had written some pornographic graffiti relating to children on the wall of his cell.

He was moved to another cell but the next month guards found that he had been writing more pornographic graffiti relating to children — this time underneath a desk.

In Tasmania, child exploitation material includes any written material that described a person under the age of 18 in a sexual context that a responsible person would regard as offensive.

Day was released but within 10 weeks had reoffended and was jailed again in August 2013 for more child pornography offences.

In June 2015, guards found a number of stories written by Day about children engaging in sexual activity.

Tasmania’s Chief Justice Alan Blow described the circumstances as “unusual”.

“Any reasonable person would regard them as being particularly offensive,” Chief Justice Blow said.

The Supreme Court in Hobart heard Day suffered from bipolar disorder and all of his offending had occurred during manic episodes.

Day has no children of his own and the court heard there was no suggestion he had ever harmed a child.

No further imprisonment necessary: Chief Justice

Chief Justice Blow said unlike a previous conviction where Day had circulated offensive material on the internet — his in-jail writings had a “particularly small readership”.

“And is not likely to have done any harm beyond creating feelings of disgust and revulsion in those who had to deal with it,” Chief Justice Blow said.

Day’s previous sentence expired in May and he has been on remand for the latest offences since then.

Chief Justice Blow said he felt that no further term of imprisonment was necessary.

He backdated Day’s four-month sentence to his May release date, meaning the 60-year-old will serve no further jail time.

Day will be on probation for the next three years with special conditions that he submits to psychiatric assessment or treatment as directed by a probation officer.



Sentenced in the Supreme Court on federal charges of using a carriage service to access 

child exploitation material, using a carriage service to transmit child exploitation material 

and state charges of possessing child exploitation material & breaching a recognisance. 

Justice Tennent ordered he serve the remaining 2½ years of the original sentence, another 

year in jail for the fresh Commonwealth offences, to begin six months before the expiration 

of the first sentence and 174 days in jail for the state offence, backdated and equivalent to 

time he has already served awaiting sentencing.

‘Depraved’ man jailed for child porn

A “DEPRAVED” New Town man who wrote about raping, murdering and torturing children was attracted to child pornography because of the status he received as a network administrator, a Supreme Court judge has said.

Sonny Day, 55, pleaded guilty to 67 child porn charges including accessing child abuse material and publishing seven stories that fantasised about the physical and sexual abuse of an abducted child.

He was sentenced to five years’ jail and received a life listing on the sex offenders registry at the Supreme Court in Hobart yesterday.

Day accessed child porn from July 1, 2006 until his arrest on December 1, 2010, and took steps to make his IP address hard to trace.

Australian Federal Police discovered 1971 images and videos of child pornography at his house.

They included 94 videos and 107 images at the very worst end of the Oliver scale which classifies indecent images.

It included four videos and 20 images depicting child abuse.

Four of the images depicted dead toddlers.

“Some of the images included text boxes containing pornographic or abusive comments, including comments describing acts of sadism, torture and murder,” Justice Alan Blow said.

Police also found a collection of printed stories of a “very high level of depravity”, as well as stories he had penned, which Justice Blow said “are in the worst category of child abuse writing and show an extreme level of depravity.”

“In his emails, Mr Day wrote about ideas he had about raping, torturing and murdering children, including babies, together with other offenders, and filming such acts,” he said.

Justice Blow said that while child porn stories do not harm children in their production, they are “evil” because they “sought to actively encourage depraved and dangerous acts.”

Day told police he had sexual urges toward children he knew and so limited his contact with young children.

He has been in custody since breaching his bail on Christmas Day 2010 by loitering near children at a park in Sandy Bay.

He has been assaulted twice in prison.

Day will be eligible for parole in June 2013.

    We have become aware that Sonny Day was originally known as Craig Whitchurch, or Whitechurch & we wondered if you had info on him under name?
    Unbelievable that a child pronograoher would be housed with 2 paedophiles.
