Former Ballarat teacher who had sex with student released from jail

The Courier – 28 Sep, 2011 10:19 PM

A FORMER Ballarat High School music teacher who had sex with two students has been released from jail on parole.

In 2009, Michelle Lynne Dennis was sentenced to four years and three months’ jail, with a minimum of two years and 10 months for having sex with the boys, aged 14 and 17.

In February, Dennis successfully appealed her sentence to the Supreme Court, which was reduced to three years with a non-parole period of 18 months.

The Adult Parole Board confirmed yesterday Dennis was released on May 17, subject to a strict supervision regime.

Parole board general manager David Provan said it was “in the interests of the community” to release suitable and rehabilitated offenders.

“Releasing offenders on parole allows the board to impose a strict supervision regime and other conditions appropriate to support the reintegration of the offender into the community and to minimise the risk of recidivism,” he said.

The County Court at Ballarat heard Dennis sent more than 1300 text messages to the two students over a two-year period. She also sent one of the boys naked pictures of herself.

Dennis pleaded guilty to two counts of sexual penetration of a child under supervision and one count of sexual penetration of a child under 16.

She remains on the sex offenders’ register for life.

A former Ballarat teacher has been jailed for at least two years and 10 months for having sex with two students.

Michelle Lynn Dennis, 33, had sex with the boys, aged 14 and 17, while employed as a music teacher at Ballarat High School.

The County Court at Ballarat heard Dennis sent more than 1300 text messages to the students over a two-year period.

She also sent one of the boys naked pictures of herself and invited one of his friend’s to have a threesome with them.

Dennis pleaded guilty to two counts of sexual penetration of a child under supervision and one count of sexual penetration of a child under 16.

She was convicted and sentenced to four years and three months’ jail, with a minimum of two years and 10 months to serve.

She was also ordered to be placed on the sex offenders’ registry for life.

Judge Susan Cohen described Dennis’ offending as ”serious” and a ”betrayal of trust”.

”Teachers have a high ability to influence students and that gives them a responsibility not to abuse their position,” she said.

Judge Cohen said Dennis had initiated the offending and shown ”little remorse” for her actions.

”Each occasion was instigated by you where you drove them somewhere inappropriate,” she said.

Dennis sat in the dock with her head down during the hearing and cried when her sentence was read out to the court.

UPDATE 5.34pm: A FEMALE teacher has been committed to stand trial where she will face charges related to sexual acts with two schoolboys.

Michelle Dennis, in her early 30s, will face more than two dozen charges, all related to the sexual penetration of a child aged under 16 or between 16 and 17, or indecent acts involving a child aged under 16 or between 16 and 17.

A former friend of one of the boys today told Ballarat Magistrates Court today he first met Ms Dennis when she picked up his friend from near his house in the middle of the night early last year.

“She was rather rude and said she was the adult and she knew what she was doing,” he said.

He told the court his friend returned later and boasted about the alleged sexual activity, including oral sex.

He also told of text messages and images of breasts he claims were sent from Ms Dennis to the boy.

Ms Dennis was charged last October with three counts of sexual penetration of a child aged under 16 and one count of committing an indecent act.

She was immediately suspended from teaching by the Victorian Department of Education.

Those charges came just days after Ms Dennis was stood down from Ballarat High School after being charged with three counts of sexual penetration of another student, aged 17 or under.

The new charges are understood to have come after a male former student of the school contacted police.

All charges relate to alleged sexual encounters between Ms Dennis and two students outside the school grounds last year.

She will front a directions hearing at Melbourne’s County Court on Sep 8.

Sen-Det Tony Euvrard, of Ballarat CIU, last year told the Herald Sun the scandal had rocked the city.

“It’s not common for someone to be charged with a sexual offence against even one high-school student, let alone a female teacher,” he said.

Ms Dennis was a teacher at Ballarat High from 2003 to 2008.
