A Perth man has been sentenced to ten months jail for indecently touching two young boys when he was a Christian Brother at a Catholic school more than 20 years ago.

Graeme James Down, 57, pleaded guilty to two charges which dated back to 1984 while the two 10-year-old boys were on camps.

Down is already serving a 30 month jail term for similar offences against other young boys committed around the same time.

The District Court was told Down was extremely sorry for the hurt he caused his victims, but after leaving the school a short time after his crimes, he had led a productive and blameless life.

Down will be eligible for parole.,20867,21102089-5006789,00.html

‘Boy abused for being disruptive’

A CHRISTIAN Brother sexually abused an adolescent student more than 20 years ago after he had been a “bad boy” and disrupted class, a Perth court was told yesterday.

Graeme Down, 55, who recently left his job as regional co-ordinator for the State Emergency Service in Kununurra, pleaded guilty to indecently dealing with three boys while he was a teacher at St Mark’s College in the Perth suburb of Bedford in the early 1980s. But he has denied abusing a fourth boy in 1982 and 1983.

He is on trial in the Perth District Court for six counts of indecent dealings and one count of carnal knowledge.

The 35-year-old victim, who the prosecution alleges was 10 and 11 at the time of the offences, broke down repeatedly while giving evidence via closed circuit television yesterday.

At one stage, he shook his head as he sobbed, saying to a court officer: “I can’t do this”.

After regaining his composure, he told the jury how Mr Down had held him back after class on three occasions for being disruptive, bullying another student and to discuss a test.

“I stayed behind and that’s when he put his left hand towards my groin,” the man said, referring to the first incident.

On another occasion, he spoke of Mr Down abusing him while wearing a cross on his collar.

The man said Mr Down, a religion teacher, had pulled his shorts down and touched him inappropriately. He had been forced to perform oral sex and had been sexually penetrated by Mr Down.

Prosecutor Brent Meertens said the 35-year-old had been scared, ashamed and thought no-one would believe him. “When the complainant asked (Mr Down) why (he was being abused), he said he had been a bad boy and this was his punishment.”

The trial continues today.
