Custodial sentence for possessing child pornography

Wingham Chronicle – 01 Jun, 2010 12:14 PM

A 74-YEAR-old Wingham man has been sentenced to nine months of periodic detention after he was found with about 400 images of child pornography.

Lionel Winston Filewood, of Wingham Circuit, was charged after a computer technician discovered suspect photographs on a laptop he had taken to a Taree store for repairs.

Filewood was sentenced in Taree Local Court last week after pleading guilty to a charge of possessing child pornography.

Police facts tendered to the court stated that after Filewood took his laptop computer to Coastal Computing Solutions for repair on March 1, a staff member began working on the faulty machine, discovering a number of images of child pornography.

The staff member contacted police and on March 4 the laptop was seized under warrant.

About noon that day police executed a search warrant on the residence of Filewood, who was not at home.

Police seized a number of computer items and at 4.45pm that day, Filewood contacted police and agreed to attend the Taree police station for an interview.

At 9.15am the next day he attended the station and under formal interview admitted he had about 200 child pornography images on his laptop. He said these images involved children under the age of 12 who were engaged in sex acts with both adults and other children.

He also informed police he had copies of most of the images saved onto another hard drive – making a total of about 400 images.

Solicitor Stephen Young, representing Filewood, said Filewood was about to begin receiving professional rehabilitation assistance and was a man of good character with no prior convictions on his record.

“The number of photographs and images would suggest this was not a passing fad, but an area where you have had a macabre interest for some time,” Magistrate Mr Shaughan McCosker said.

“It is in the interest of all persons that this particular industry is decimated,” he said, adding that there needed to be a very strong element of deterrence in the sentence.

Mr McCosker acknowledged that Filewood was a 74 year-old man who had not been heard of by the court before, and that he had pleaded guilty at his first opportunity.

“The court must look at a term of imprisonment,” Mr McCosker said. “(Due to Filewood’s age) any time served in prison would be hard time for you.”

A man is due to reappear in the Taree Local Court next month after being charged with possessing child pornography.

Lionel Filewood, 74, turned himself in to police last week after computer repairers allegedly found pornographic images on his laptop.

Officers raided the house and say they found more than 400 child pornography images on Filewood’s computers.

He was granted conditional bail and is due to appear in court again on April 6.
