Judge jails junior-footy paedophile trapped by mum

A football team manager who had sex with an underage player has been jailed for 10 months.

Kimberley Gale, 24, pleaded guilty to two counts of sexual penetration of a child under 16.

The County Court heard Gale was a team manager of a northern suburbs under-16s football team earlier this year.

After befriending the 14-year-old boy’s mother, Gale offered to take him to school on her way to work.

Judge Sue Pullen said that on two occasions, between March and June this year, Gale, instead of taking the boy to school, took him back to her house where they kissed and had sex.

Judge Pullen said that on other occasions Gale had placed her hand on the boy’s thigh and told him he was “hot”.

The judge said “there is no doubt in my opinion your offending was serious”.

The court was told that Gale’s behaviour was discovered when the victim’s mother confiscated his mobile phone and Gale sent him a text message.

In the message she said: “I really miss talking to you.” The victim’s mother, pretending to be her son, replied: “Really?”.

Gale replied: “Yeah, really, really badly. I knew I was in love with you but I didn’t realise how much I missed you.”

Prosecutor Susan Borg told Judge Pullen that “a clear message needs to be sent to her that she cannot repeat this behaviour.

“A clear message needs to be sent to the community that when it comes to sex, children are off limits.”

Gale will be a registered sex offender for life. Judge Pullen agreed with the prosecution that a partially suspended sentence was appropriate in Gale’s case.

Judge Pullen jailed Gale for two years and two months, to immediately serve 10 months.

The remaining 16 months will be suspended for two and a half years.

Gale wept as she was led from the dock into custody.

A YOUNG woman told a 14-year-old boy’s mother she was driving him to school before taking him to her home and having sex with him, a court heard.

Kimberley Annette Gale, 24, of Hillside, pleaded guilty in the County Court to two counts of sexual penetration of a child under 16.

Her lawyer, Amy Wood, told Judge Sue Pullen her client had had a difficult childhood and the attention of the boy, plus moving back home to live with her mother and stepfather, had made her feel “like she was 16 again”.

The court heard Gale met the boy and his mother through their involvement in a suburban football club.

Prosecutor Susan Borg said Gale had become friends with the mother at the club and after overhearing her say she was having trouble getting him to school, Gale offered to drive him there.

For three or four weeks in March and April, Gale drove the boy to school every morning, and on at least one occasion put her hand on his leg and told him he was “hot”, Ms Borg said.

On one occasion Gale, then 23, asked the boy if he wanted to spend more time with her, and he replied “yes”. She drove him to her family’s home. The pair had sex then she drove him to school.

Two weeks later, they went to Gale’s home again on the way to school and had sex.

Ms Wood said her client knew the relationship was wrong but had become “blinded” by the attention the boy had given her.

Judge Pullen said; “What we have here is a 23-year-old woman and a 14-year-old boy and she knew what she was doing was wrong.”

When the school contacted the mother to say her son had been late several times, she was puzzled and contacted Gale who said she had been stuck in traffic, Ms Borg said.

The mother told Gale she would make alternative arrangements for her son and confiscated his mobile phone.

Gale texted the boy’s phone, saying she missed him. After the mother responded “really?” she sent another telling him she loved him.

Confronted by his mother, the boy broke down and admitted the relationship.

Gale pleaded guilty to two counts of sexual penetration of a child under 16. The plea hearing was adjourned to December 15 for a psychiatric assessment of Gale, who was remanded in custody.

A WOMAN who twice had sex with a 14-year-old boy was not a predator but was motivated by a longing for love and security, a court has heard.

Kimberley Gale was 23 when she met the boy through a suburban football club, where she was a team manager, the Victorian County Court heard.

She drove the boy to school over several weeks during which she put her hand on his leg, told him he was “hot” and they should spend more time together, and he agreed.

They had sex twice at her home during a two-week period between March and June this year, and on the first occasion he received a late notice from school.

The boy’s mum became suspicious when Gale blamed traffic for her son being late.

Gale pleaded guilty to two counts of sexual penetration of a child under 16.

The court heard that between the first and second offences, she had admitted her actions were wrong.

Defence barrister Amy Wood said her client was not a predator of young boys but an emotionally immature woman who was longing to be loved.

Ms Wood said Gale had a horrific childhood in which she was tormented and abused by her brother and step-brother.

A psychologist’s report found the emotional neglect she suffered and the abuse caused deep sensitivities and her actions were motivated by a desire for love and security.

Ms Wood asked that Gale receive a wholly suspended sentence because she had a low risk of reoffending, had pleaded guilty early and had a clean record.

She said Gale had shown remorse and insight and had offered to pay for counselling for her victim and his mother, despite being financially strapped.

Ms Wood said Gale had lost her real estate job after being charged and was now working three jobs and funding her brother’s private school education.

She said her crimes were at the lower end of offending.

But prosecutor Susan Borg called for a jail term, saying a partly suspended sentence was within the range.

She said it was concerning that Gale was being portrayed as a “love-struck, doe-eyed girl” when in fact she was an adult who had had sex with a boy.

“She was expected to take him to school but instead took him to have sex in her home,” she said.
Ms Borg said Gale told police she had been “swept away”.

But the victim was “obviously struggling with what was happening” and cried when it was revealed.

Gale, 24, of Hillside, was remanded in custody pending a psychiatric assessment. She will be sentenced at a date to be fixed.
