Ex-AFP officer to be re-sentenced for child porn

A former Australian Federal Police officer who appealed against his jail sentence for downloading child pornography will be re-sentenced.

Michael Edward Hatch, 38, was one of about 100 people arrested as part of Australia’s biggest child pornography investigation, Operation Centurion.

The Canberra man had nearly 30 sexually explicit images of young girls stored on his home computer.

Hatch was sentenced to 14 months in jail, to be suspended after five months for good behaviour.

Hatch’s lawyers filed an appeal in the ACT Supreme Court against the severity of the sentence.

Today in the ACT Supreme Court, Justice Malcolm Gray said that given the evidence imprisonment was the only option.

But he set aside the sentence and referred the case back to the ACT Magistrates Court so family and psychological circumstances can be taken into account in re-sentencing.

Judge steps down from child porn conviction appeal

A Canberra judge has disqualified herself from hearing the appeal of a former Australian Federal Police officer convicted of downloading child pornography.

Michael Edward Hatch was arrested in March as part of the country’s biggest child pornography sting.

Police found nearly 30 sexually explicit images of young girls stored on his home computer.

Magistrate Karen Fryar sentenced him to 14 months in jail, to be suspended after five months.

She ruled that it was inconceivable that a serving police officer would not have known the ramifications of viewing the images.

Hatch’s lawyers are appealing against the sentence.

Today they successfully applied to have ACT Supreme Court Justice Hilary Penfold disqualified from hearing the appeal, on the grounds that she compared and contrasted Hatch’s case in a similar sentencing yesterday.

Justice Malcolm Gray is now hearing the appeal.

A SUPPRESSION order has been lifted on the name of an ACT police officer who has pleaded guilty to child pornography charges.

Michael Edward Hatch, 38, was suspended from duty in March after he pleaded guilty in the ACT Magistrates Court to using a carriage service to access child pornography and possessing child pornography material.

Magistrate John Burns had suppressed Hatch’s name until today after crown prosecutor Duncan Berents said making it public could jeopardise an ongoing investigation by the Australian Federal Police (AFP).

Hatch was arrested after investigators from the AFP’s professional standards unit searched his home in suburban Belconnen on March 21.
