Court sets child porn addict Donald Judge, 69, free

HE downloaded thousands of images of child pornography but a judge has spared a grandfather time in jail after saying his “compulsory personality” was behind his depraved behaviour.

Judge Ronald Solomon told the court 69-year-old Donald Judge had progressed from alcohol to child pornography. The District Court was told Judge had battled addictions to gambling and alcohol, and had for the past 10 years been “addicted” to pornography.

“It comes as a surprise to me that an alcoholic would divert to pornography but that appears to be the case,” Judge Solomon said.

Some of Judge’s fellow members of Alcoholics Anonymous sat at the back of the District Court to support him.

Victims groups were shocked yesterday to learn that there is no way to appeal against the new sentence.

The judge allowed Judge’s appeal against his 18-month jail sentence imposed at Manly Local Court last year.

Instead he was given a suspended sentence, 250 hours of community service and ordered to enrol in a Sex Offenders Program.

He had pleaded guilty to possessing child abuse material.

Some of it was discovered on Judge’s laptop by a computer repairer in February last year.

The repairer contacted police, who seized several hard drives, 16 DVDs and two more computers from Judge’s Whale Beach home.

They found 6690 images of child pornography and 2382 videos. They included rape and bestiality.

Judge Solomon said it appeared the grandfather had collected child pornography for about 10 years.

“The young persons who are involved in the films and the videos and the photographs are exploited … each time the images are viewed the exploitation continues,” he said.

But Judge Solomon said he took into account Judge’s age and health issues, and the fact that he had “taken all steps” to assist himself in overcoming his addiction and had mentored people in Alcoholics Anonymous.

The Daily Telegraph revealed earlier this week that child sex offenders were getting lesser sentences than financial criminals. Bravehearts criminologist and head of research Carol Ronken said the courts had to send a clear message that “child sexual assault, in all its forms will not be tolerated”.

“Behind every photo and every video is a child sexually harmed. There is absolutely no excuse for child sexual exploitation,” Ms Ronken said.

A spokeswoman for the DPP said there was no “mechanism for the DPP to appeal the inadequacy of a sentence imposed by the District Court from an appeal from the Local Court”.

A WHALE Beach grandfather was yesterday sentenced at Manly Court to 18 months in jail for possessing child pornography and child abuse material.

Donald Judge, 69, pleaded guilty on June 20 to six counts of possessing child abuse material. At the sentencing submission on November 1 the court heard that Judge had an addictive personality.

As a member of Alcoholics Anonymous he had acted as a mentor to other members.

Judge had previously battled addictions to gambling and alcohol, and had for the past 10 years been addicted to pornography.

According to a statement of police facts tendered in court, Mr Judge brought his iMac into a local computer shop on February 1 complaining that it would not start up.

He told a technician he had “highly sensitive material” on his hard drive, and requested that it was not accessed.

The technician began work on the computer and found images of child pornography.

Police were immediately called to view the files, a search warrant obtained and the following day Judge’s home was raided.

Police seized several hard drives, 16 DVDs and two more computers. Examination of these by the Electronic Evidence Branch found up to 6690 images of child pornography and up to 2382 videos.

The court heard that downloaded material contained images of children as young as five.

A WHALE Beach grandfather, facing a host of child pornography charges, told a local computer shop he had “highly sensitive material” on his hard drive when he brought it in to be repaired.

Donald Judge, 69, yesterday pleaded guilty in Manly Court to six of eight counts of possessing child abuse material following his arrest on February 2. According to a statement of police facts tendered in court, Mr Judge brought his iMac into the shop on February 1 complaining that it would not start up.

“The accused further stated he had highly sensitive material on the hard drive and requested that it was not accessed,” the facts stated.

The technician began work on the computer and identified that it was at 95 per cent capacity. Upon further examination he found a file called “empty” which contained a number of sub-files with graphic names.

The technician opened the files and saw images of child pornography.

Police were immediately called and viewed the files.

A search warrant was obtained and the following day police raided Mr Judge’s home, seizing several hard drives, 16 DVDs and two more computers.

Examination of these by NSW Police State Electronic Evidence Branch found up to 6690 images of child pornography and up to 2382 videos, according to the police facts.

Mr Judge will appear in Manly Court for sentencing on July 25.

In the meantime, his bail conditions stipulate that he is not to use the internet and must not have access to any person under the age of 18, other than grandchildren.

New child porn charges for Whale Beach man

A WHALE Beach man arrested for possession of child pornography after a tip-off from a local computer repair shop has been charged with seven more offences.

Police allegedly found more child pornography on several portable hard drives, 16 DVDs and two more computers during a February 2 search of Donald Judge’s home. The 69-year-old is yet to enter a plea to the eight charges of possessing child abuse material.

Judge was arrested on February 2 after staff from a local computer repair shop alerted police to having discovered the allegedly pornographic material.

Police verified it on the iMac computer in the shop before searching Judge’s home on the same day.

They allegedly seized further computer equipment, CDs and DVDs.

Judge was arrested and taken to Dee Why police station, where he was charged with possessing child abuse material.

Police allegedly found more child pornographic material on a Western Digital hard drive, a Seagate hard drive and four other portable drives.

Judge faced Manly Local Court yesterday.

An application to have one of his bail conditions altered so that he could see his grandchildren was approved.

The bail condition was changed from an earlirer one that Judge could not have access to any person under the age of 18, to one that he could not have such access “except with his grandchildren in the presence of an adult family member”.

The bail condition stating he is not allowed to access the internet was continued.

A WHALE Beach man, who was arrested for possession of child pornography following a tip-off from a local computer repair shop, has faced Manly Local Court.

Donald Judge, 69, did not enter a plea today and the matter was adjourned for six weeks pending further investigations by police.

More charges are expected to be laid. Mr Judge was in no mood to face the cameras as he left court, having tied a raincoat tightly to his face.

Another man then attempted to block the Manly Daily’s photographer with an umbrella. Mr Judge was arrested on February 2 after staff from a local computer repair shop alerted police to having discovered the allegedly pornographic material.

Police verified it on the i-Mac computer in the shop before searching Mr Judge’s home.

There they allegedly seized further computer equipment, CDs and DVDs. He was arrested and taken to Dee Why police station, where he was charged with possessing child abuse material. Mr Judge will next appear in Manly Court on May 2.
