A former Ballarat teacher will be sentenced next year for committing indecent acts with two students.

In the County Court sitting in Ballarat, in central Victoria, Dennis Stewart, 50, pleaded guilty to four counts of committing an indecent act with a child under 16.

Stewart, of Beaumont Hills in New South Wales, is due to face court again in Melbourne, in February.

The court has suppressed the name of the school where he taught.

Former Ballarat teacher bailed again on sex assault charges

A FORMER Ballarat teacher accused of sexually assaulting male students has been granted bail for the second time.

Dennis Michael Stewart, 49, was released from custody yesterday afternoon but under strict bail conditions, including to reside with family at an interstate address.

Stewart is yet to enter a plea to 18 charges, including to 17 counts of committing an indecent act with a child under 16.

Since his bail was revoked two months ago, the police case against Stewart has grown and now includes four child complainants.

Stewart appeared in the dock of Ballarat Magistrates Court yesterday, where he cried while being sworn in to give evidence.

While on oath, he admitted he had previously breached bail conditions by contacting students at the Ballarat-based school where he previously taught, the name of which cannot be published for legal reasons.

When asked why he did it, Stewart said: “I think I was at a point where any support was appreciated.

“I certainly will not create another (social media) page, and if I did I’m sure it would be picked up quickly,” he said.

Stewart also gave an undertaking to the court not to contact students.

Defence barrister Tom Danos argued that because the matter had since gone into the committal stream, delay was a major issue with a potential trial date unlikely this year.

He said Stewart also had pressing health problems, including requiring urgent dental work that could not be done in custody.

“He has very clearly learnt a salutary lesson in what occurred then (with the breach),” Mr Danos said.

“He is now prepared to do everything he can to avoid doing it again.”

After much deliberation magistrate Peter Couzens granted bail, acknowledging Mr Danos’s submissions.

“Delay is particularly significant given the health issues of Mr Stewart,” he said.

“It’s not an easy application to deal with given the nature of the charges.”

When Stewart appeared in court last November, Detective Senior Constable Mathew Young gave evidence and claimed Stewart had touched a boy’s genitals on two separate occasions and masturbated in front of him.

He said Stewart had also walked in on the teenager while he was in the shower, and would himself walk around naked in front of him. Stewart is due back in the same court on May 31 for a committal mention hearing.

Former Ballarat teacher denied bail over child sex offences

A FORMER Ballarat teacher charged with child sex offences will remain in jail after a magistrate refused him bail yesterday.

Dennis Stewart, 49, appeared in Ballarat Magistrates Court charged with nine counts of committing an indecent act with a child under 16.

The charges stem from allegations made by two male students at the school where Stewart previously taught.

The teacher initially appeared in court in November last year charged with sex offences against one student and was granted bail under strict conditions.

His bail was revoked earlier this month when police found he had been communicating with the alleged victim through social media. It was at this time further charges were laid when a second alleged victim came forward.

Yesterday, magistrate Andrew Cappell denied Stewart’s second application for bail.

He will reappear in court at a later date. A suppression order remains in place prohibiting the publication of the school’s name.

Ballarat teacher’s bail revoked in sexual assault case

A BALLARAT teacher accused of sexually assaulting a male student has had his bail revoked after it was alleged he recently communicated with students through social media.

Dennis Stewart, 49, was bailed last November under strict conditions including not to contact students who were enrolled at the school – which cannot be named – while he was a teacher there.

Yesterday he remained in New South Wales while his case was heard in the Ballarat Magistrates Court, however, a warrant has been issued for his arrest.

Detective Senior Constable Mathew Young from the Ballarat sexual offence and child abuse investigation team told the court police this week became aware of an alleged breach, which involved a series of communications between Stewart and multiple students.

“Police have real concerns (about the communications), it’s jeopardising our ability to contact students,” he said.

“Our rapport building with (students) has been damaged by this.”

Detective Young said Ballarat police had also received information that police in NSW were going to lay similar charges against Stewart, relating to a different set of alleged offences.

Police prosecutor Senior Constable Steve Kent described the alleged breach as “not an innocent contact”.

“These are sinister contacts … designed to re-engage with the victim and manipulate other children,” he said. “It is not ambiguous not to contact students.”

Defence lawyer Jeremy Harper said Stewart acknowledged breaching his bail, and had abided by conditions since.

“He’s very sorry for breaching bail in that way, he didn’t mean any harm by it,” Mr Harper said.

“He’s certainly well aware of the seriousness of the situation now.”

But magistrate Kay Robertson took little time to revoke bail, saying it was the only appropriate response from the court. Stewart has been charged with eight counts of committing an indecent act with a child under 16.

When Stewart appeared in court last November, Detective Young claimed that late last year Stewart had touched the boy’s genitals on two separate occasions and masturbated in front of him.

He said Stewart had also walked in on the teenager while he was in the shower, and would himself walk around naked in front of him.

Stewart is due back in court in March.

Ballarat teacher bailed over student assault accusations

A BALLARAT teacher accused of sexually assaulting a 13-year-old student has been granted bail.

Dennis Stewart, 49, was released from custody earlier this afternoon on the understanding that he will leave Ballarat and reside with family in New South Wales.

He is facing eight charges of committing an indecent act with a child under 16 relating to a period between September and November this year.

Stewart’s name can be published after magistrate Peter Couzens lifted a suppression order, however the name of the school at which he taught remains suppressed.

His application for bail was opposed by police on the grounds he was an unacceptable risk of failing to answer bail and of interfering with witnesses or obstructing justice.

Yesterday, Detective Senior Constable Mathew Young from the Ballarat sexual offence and child abuse investigation team gave evidence, telling the court Stewart had showered a 13-year-old male student with gifts.

Detective Young claimed he had touched the boy’s genitals on two separate occasions, and masturbated or played with himself in front of the child on eight occasions.

He said Stewart had also walked in on the teenager while he was in the shower, and would himself walk around naked in front of him.

The court heard police executed a warrant at Stewart’s home last week, seizing a computer which is still to be analysed.

The officer said New South Wales police were also commencing proceedings against Stewart over alleged child sex offences between 2005 and 2008.

Stewart was bailed under strict conditions, including daily reporting to police and to surrender his passport.

He is due to reappear in court on March 14 for contest mention.

    Dee Stewart was sentenced today in the County Court in Melbourne his sentence is 27months non parole period of 18months. Two of us travelled from Sydney to witness this mongrel bastard be sentenced. the pathetic waste of space that he is shed a few tears. He is now in jail. The Ballarat police have done an outstanding job.

    This pathetic man received 2 x 9 month suspended sentences in NSW yesterday. The best out come is he is now on the NSW child protection register. His power has been stripped from him in so many ways, I hope this helps all those innocent young boys and their families in all states that he has impacted begin to heal.
