CONVICTED child-sex offender and former-MP Terry Martin was attacked a Tasmanian court outside court this afternoon.

In dramatic scenes, the former Legislative Councillor, who was late last year convicted of having sex with a 12-year-old prostitute, was struck by relatives of the girl as he was being led from Hobart’s Supreme Court this afteroon.

Martin, 54, was found guilty of having sex with a child by a jury late last year after he hired the girl who was being prostituted by her mother and mother’s friend in late 2009.

Martin was leaving the Supreme Court in Hobart after being handed a wholly suspended jail term for possessing child pornography.

The girl’s grandmother and aunt shouted abuse at Martin as he entered St David’s Park just before 4.30pm.

The Parkinson’s Disease sufferer was hit in the head with a handbag, struck with the grandmother’s walking stick and apparently punched before security guards and his defence team managed to free him from the fracas and lead him out of the court to safety.

Call for jail as family speaks

DEVASTATED family members of a 12-year-old girl prostituted to more than 100 men in 2009 have broken their silence.

Relatives attended Terry Martin’s court proceedings but did not identify themselves or make any comment until yesterday when a spokeswoman for the family spoke out after his sentencing.

“For those who are not clear why [Martin] should not have been charged think about this,” the woman, who cannot be identified, said.

“He was the only one known to see [the girl] in light, even taking photos which which prove he had time to talk to her.

“The family feels these are more than good enough reasons for him to have been charged,” she said.

The family says Martin deserved jail time because he should have known she was underage.

“He could have protected her by stopping her sexual abuse if he reported it as a good person and member of the community,” the family spokeswoman said.

“We wish none of this occurred,” the spokeswoman said.

“The invisible psychological scars will never disappear.”

The family said sentencing for perpetrators of sex offences was too lenient.

The woman said the family also hoped that the end of Martin’s trial would mean they were able to deal with the ramifications of the ordeal in private.

“We hope the news she was prostituted can be laid to rest so we can have no more reminders in the paper, no more news programs reminding her, or us, of the horror she went through. It is time to try and move forward with our lives.”

The girl’s mother and her friend, Gary John Devine, are serving lengthy jail sentences for prostituting the girl.

Ex-MP guilty of sex with child prostitute

A former Tasmanian MP has been found guilty of having sex with a 12-year-old girl sold into prostitution.

A Supreme Court jury yesterday found former upper house MP Terence Lewis Martin guilty of unlawful sexual intercourse with a young person and producing child exploitation material.

It could not reach a verdict on a third charge of indecent assault.

Martin, 54, denied all three charges, saying he responded to an ad for adult sexual services in September 2009 and thought the girl was 18.

Martin was a client of a 12-year-old girl who was prostituted in 2009 by her mother and Glenorchy man Gary Devine – who have both been jailed for prostituting the girl.

After paying for sex with the girl in Devine’s dimly lit flat, Martin organised for her to visit him at his home for sex. It was this visit that led to charges being laid.

During the visit, Martin and the girl engaged in sexual activities and he took photographs of her posing sexually, for which she charged an extra $100.

The Crown argued Martin ought to have known the girl was younger than 17 but Martin told police during an interview played to the jury last week that he believed the girl to be 18 and that nothing in her behaviour or conversation suggested she was younger.

Five other clients of the girl also told the jury during the trial that they believed the girl was at least 18 years old but four of those men had only encountered the girl in Devine’s flat.

During his police interview, Martin said medication he had been prescribed for Parkinson’s disease had caused hypersexuality and had led to an addiction to prostitutes and pornography.

Martin has been remanded in custody before sentencing submissions today.

His lawyer, Peter Barker, said he would be seeking a non-custodial sentence on medical grounds.

He provided two medical reports, one from a neurologist and one from a psychologist.

“In general terms both of those reports go to the issue of hypersexuality,” he said.

Mr Barker said there was no risk of Martin reoffending.

“The hypersexuality has been addressed by a change in the medication,” he said.

The girl, who cannot be named, was prostituted to more than 100 men by her mother and her associate.

The two took a classified advertisement in Hobart’s Mercury newspaper, which described the girl as “Angela, 18, new in town”.

MP fronts court over child sex charges

Tasmanian Upper House MP Terry Martin has appeared briefly in a Hobart court to face child sex charges.

Martin is facing three charges including possessing child exploitation material and having sexual intercourse with a person under the age of 17.

The 52-year-old is also accused of producing child exploitation material in September last year by taking photos of a naked 12-year-old girl performing a sex act.

Martin’s lawyer previously indicated his client intends to plead not guilty to the charges.

Today the Supreme Court in Hobart heard prosecutors provided Martin’s lawyer with statements and other documents.

Outside court Martin said he was unable to comment but wished he could.

He will face court again next month.
