David William Eccles sentenced for child pornography ’found at abandoned campsite’

A MAN who kept child pornography he found on a mobile phone at an abandoned campsite has received a suspended sentence.

David William Eccles, 32, of Encounter Bay, had pleaded guilty to two counts of possessing child pornography — some of which was of children aged under 14.

In sentencing, District Court Judge Julie McIntyre said Eccles submitted he had found the child pornography on a mobile telephone’s SD card at an abandoned campsite but had failed to delete it.

“You could not get the telephone to work, so you put the SD card in your own phone and you saw that there were child exploitation photographs on it,” she said.

“At this point you should have either destroyed the card or taken it to the police — instead, you kept it for over a month before a friend informed the police about the card.”

Judge McIntyre said there were 41 photographs, 23 of which depicted children under 14 years old.

She said a psychologist report tendered to the court said Eccles suffered from an intellectual problem and was not keeping the child pornography for prurient purposes.

Judge McIntyre sentenced Eccles to one year and two months jail with a non-parole period of seven months.

She suspended that sentence upon Eccles entering a $500, 18-month good behaviour bond.
