Alan John Burton given suspended sentence for child pornography offences

An Adelaide man who admitted possessing and producing child pornography has been given a suspended sentence.

Alan John Burton, 31, of Paralowie, pleaded guilty in the Adelaide District Court to nine counts relating to child pornography.

Burton admitted he pretended to be a 12-year-old girl on internet chat forums.

Police found evidence of nearly 50 conversations between Burton’s girl persona and adult paedophiles.

When arrested, Burton said he did not realise he was committing an offence.

Judge Paul Muscat said Burton’s actions contributed to the “ongoing evil” associated with child sexual abuse.

He sentenced Burton to 18 months in jail with nine months non-parole.

Judge Muscat said Burton was remorseful and unlikely to reoffend, so suspended the sentence.

Man gets bond for disabled woman’s assault

A man who indecently assaulted a disabled woman has been given a suspended jail sentence by the Adelaide District Court.

Shivam Kohli, 22, assaulted the wheelchair-bound woman at a city motel in April last year.

He was accused of two counts of rape, but pleaded guilty to lesser charges during his trial.

Judge Steven Millsteed said Kohli had pretended to be romantically interested in the woman for his own pathetic sexual gratification.

A three-year good behaviour bond was imposed.

Lonely single mother Kylie Henry avoids jail for sex with 15yo boy

A former school canteen manager, described by a judge as a lonely single mother, has avoided going to jail for having sex with a boy of 15.

The Adelaide District Court heard Kylie Fiona Henry was 38 when she slept with the teenager, who had stayed at her northern suburbs house with his younger sisters in 2011.

Henry originally was charged with rape but a jury convicted her of unlawful sexual intercourse.

Judge Paul Cuthbertson said the verdict suggested the boy either agreed to have sex or Henry failed to realise he did not agree.

He said Henry was a lonely single mother of three and in some respects she was someone to be pitied.

“Life has not dealt you a good hand of cards,” he said.

“I have no doubt that you performed the voluntary work you did at the primary school to pass the time and to meet people.

“You were a friendly and outgoing adult to the children at the primary school.”

Woman invited boy and his sisters to visit

The court heard Henry first met the boy when he was in primary school and years later he returned to the school to watch his younger sister’s sports day.

Henry struck up a conversation with the boy’s mother and he was invited to her house to do gardening and his sisters were invited over to play with Henry’s children.

The boy and his sisters ended up sleeping over at the house.

The teenager kept watching television with Henry after the younger children went to bed and the pair later had sex.

“You were in the position of a parent, he was staying at your house with the permission of his mother,” the judge said.

“[The victim and his mother] both suffered deeply as a result of your offending.

“You became obsessed with the complainant, visiting his home virtually every day for the next three months. Your computer communications via Facebook revealed your obsession.”

The court heard jailing the woman might force her children into state care.

A two-year jail sentence was suspended and Henry was given a three-year good behaviour bond.

A former teacher and youth worker has been jailed for more than four years for child pornography offences.

The Adelaide District Court heard more than 1,500 images and videos of child pornography were found on

Stephen David Andrews’ computer, a hard drive and mobile phone.

Andrews, 55, also used an internet messaging service for sexually charged conversations with children.

Judge Geraldine Davison said Andrews had been a youth worker with the Uniting Church, and volunteered

for the children’s cancer charity Camp Quality for 18 years.

“There has been no suggestion in this matter that you have engaged in any inappropriate behaviour with

any student or any person that you have come into contact with through your volunteer work,” she said.

The judge described the content of his internet conversations, in 2011, as depraved and disgusting.

“You made reference to masturbation, inquiries as to whether the recipient of your contact has engaged in

sexual relations with their family members, graphic conversations in relation to sadistic sexual practices

and references to very violent sexual activities,” she said.

“On a number of occasions you also identify yourself as a school teacher.”

The court was told that when Federal Police arrested Andrews in November 2011, he admitted he found

child pornography sexually gratifying and that he was attracted to young girls.

Judge Davison said a significant number of the images were in the higher category of child pornography.

“You come before this court as a first offender however, as has become plain, you have been engaging in

the possession or access of child pornography over many years,” she said.

The judge said Andrews was sexually abused when he was 10 and a psychologist found that information

might help explain his offending.

Andrews will be eligible to seek parole in two years.

Court jails child-sex offender Jason Bryan Michie

A child-sex offender has been jailed for 17 months for further offending.

Jason Bryan Michie, 26, was given an eight-month suspended sentence last year for indecently assaulting a seven-year-old boy.

He was put on a good behaviour bond and the sex offenders register.

The Adelaide District Court heard Michie later was found with more than 160 images and 10 videos of child pornography.

He also joined Port Noarlunga Surf Lifesaving Club and the Country Fire Service and a scouts application package was found

at his home, along with a St John Ambulance volunteer uniform and an after-hours school care name badge.

The hearing was told Michie advertised online for babysitting work and received one reply.

Judge David Smith said the advertisement read: “I have a national police certificate and safe work around children certificate.

I can do most things whilst babysitting, preparing food, helping with homework, bath time etcetera. I have experience with

children with special needs and children with hearing problems”.

Judge Smith said Michie faced sexual abuse as a child, something only recently uncovered by a psychologist.

“When you were eight years old you were sexually abused by a friend of your father … you did not complain to your parents

at the time,” he said.

“Plainly you require treatment for the abuse you suffered … It is a significant contributor to your sexual offending.”

The hearing was told Michie regretted his actions.

His sentencing included a range of traffic offences, including using a motor scooter while disqualified.

A non-parole term of a year was set.

Sex offender back before courts

A man who referred to himself as a “kiddy toucher” has faced court after breaching terms imposed by the sex offenders register.

Jason Bryan Michie, 25, was given an eight-month suspended jail sentence last year for indecently assaulting a seven-year-old boy in his care.

At the latest hearing, the Adelaide District Court was told Michie became a volunteer at the Port Noarlunga Surf Life Saving Club and Country Fire Service just a month after his conviction.

Prosecutor Patrick Hill told the court community programs linked with those organisations would have exposed Michie to children.

The court heard Michie failed to comply with reporting obligations by moving to a shed at the back of a house where a child aged 18 months lived.

When Michie represented himself in court previously, he told a judge he did not believe he deserved legal aid because it was not for “kiddy touchers”.

At the latest hearing, Judge Simon Stretton told Michie, who again represented himself, to find a lawyer.

“You need to understand that you are at serious risk of going to jail, you don’t seem to be taking this seriously,” he said.

“It’s not certain you’ll go to jail but you are going to be significantly assisted if you have legal representation, that is a matter for you but I suggest you make it your highest priority.”

The hearing was adjourned until July.

Man avoids jail over porn video of 8yo

A South Australian man has avoided a jail term for downloading international child pornography.

Shane Padberg, 26, of Elizabeth North was among 15 Australians charged last year.

Australian Federal Police (AFP) allege a video showing the rape of an eight-year-old girl was downloaded.

The AFP said it acted on information from German police who identified 9,000 suspects worldwide.

Adelaide District Court Judge Kevin Nicholson said Padberg conceded he had more than 800 images and more than 2,000 videos of despicable pornography involving children aged between nine months and 14 years.

But the judge said the man was not considered to be a paedophile.

Padberg was given a suspended jail sentence and put on a two-year good behaviour bond.

He must get treatment and counselling.

No jail for dialing-up child pornography on demo phones in Telstra shop

A MAN who used demonstration phones in a South Australian Telstra store to download child pornography – twice – has avoided an immediate prison term.

District Court judge David Lovell said staff at the Noarlunga store had noticed Michael John Stam acting suspiciously while looking at sample phones in December 2011

“You were in the store for approximately 30 minutes and during this time you were observed by shop staff to be acting suspiciously while looking at demonstration phones,” Judge Lovell said.

“It was obvious to the staff that you did not want any attention because you would turn away from them when they approached you. You also were observed to be attempting to hide the phone with your hand.”

When Stam left the shop, staff checked the phones and discovered he had entered Google searches such as “nude naked boys”.

“They further discovered that you downloaded images of young children particularly an image of a young boy splashing in water and an image of a young female posing in a provocative manner,” Judge Lovell said.

Stam, 38, returned to the store in February 2011 and was recognised by staff, who called police.

Police observed Stam accessing a black and white image of two young boys and arrested him.

A search of Stam’s home revealed another 18 images on mobile phones of nude children under the age of 14.

The offences breached an earlier good behaviour bond for offences involving abusive and sexual phone messages to his former employer and wife.

Judge Lovell said Stam had been diagnosed with listening and learning disabilities in school, where he was often bullied and teased.

He said Stam was on a disability support pension and have never been involved in a relationship.

“Although you admit what you did was inappropriate, you fail to understand why and this is of concern to the court,” Judge Lovell said.

“I have been told and accept that you are a vulnerable individual in the community and would even be more vulnerable in the prison environment. You would not cope well with the prison environment due to your lack of understanding of social behaviour.”

Judge Lovell sentenced Stam to six months’ prison but suspended the sentence on conditions including he undergo counselling and be of good behaviour for 12 months.

Porn offender lacked awareness, court told

A court has been told a man lacked awareness why it was wrong to download child pornography and do so in a retail store.

In the Adelaide District Court, Michael John Stam, 38, of Christies Beach pleaded guilty to offences, including aggravated counts of accessing and possessing child pornography.

Prosecutors said Stam used a mobile phone in a Telstra shop to download the pornography, two years ago.

Judge David Lovell expressed concern psychological assessments indicated Stam lacked insight into his offending.

He feared the man might pose a community risk.

“I don’t think it’s a case where a short custodial sentence will teach him a lesson, so to speak, that’s the difficulty,” the judge said.

“The comforting thing for me and perhaps for the DPP is that, whilst he has been under supervision [on bail], there have been no allegations of further problems.”

Prosecutor Dominic Petraccaro agreed.

“Yes, it’s been two years and there has been no suggestion of him even attempting to access this sort of material again,” he said.

“In terms of accessing child pornography in the Telstra shop using their phone, he was always going to get caught.”

Stam’s lawyer Oliver Koehn said his client could be at risk in prison.

“He is a quite intellectually-disabled person who can mutter the right responses but when it comes down to it, doesn’t understand,” he told the court.

“He is going to be a very vulnerable person in the prison environment and will be exposed to bullying and harassment to a degree that other prisoners wouldn’t.

“This man is not completely unaware that what he did was wrong. What he is unaware of is why it is wrong.”

The prosecution said any bond would require Stam was supervised to ensure he was rehabilitated.

He will be sentenced in a fortnight.

Man jailed over swim changerooms camera

A man who filmed naked boys in a changeroom at a swimming centre with a camera hidden in his bag has been sentenced to at least 18 months’ jail.

The Adelaide District Court heard Julius Fabian Ohmer, 31, had been secretly filming children at the Elizabeth Aquadome for some time before he was arrested by police last November.

A hole had been cut in the bag and a camera used to film young boys.

During his arrest at the swimming centre, the man threw the bag into the water and police had to use capsicum spray to subdue him.

Ohmer was also found to have more than 200,000 images and films of child pornography at his home and the court heard he had a sexual fetish for nappies.

Judge Rosemary Davey said she was revolted by the offending.

The court heard Ohmer’s father was a judge in Germany.

He was sentenced to a maximum of four years in jail.

Explicit texts offender avoids jail

A man who sent explicit text messages to a teenager has been given a 15-month suspended jail sentence in the Adelaide District Court.

Anthony Charles Muscat, 52, pleaded guilty to transmitting child pornography.

The court heard he sent 135 texts to a 16-year-old girl last June, pretending to be a 19-year-old university student.

It heard the messages became increasingly explicit and he asked the girl if she had engaged in sexual activity and whether she would be willing to do so with him.

Judge Steven Millsteed said the messages were “vile and despicable” and the offending was serious.

He told Muscat he should appreciate how close he went to a jail term.

Muscat was given a 15-month sentence which was suspended for a two-year good behaviour bond.

Diving coach avoids jail for sex abuse

A diving coach has been given a suspended jail sentence by the Adelaide District Court for sexually abusing a student.

Fiasz Marikar, 45, was found guilty of three counts of indecently assaulting the teenage girl after training sessions at the Aquatic Centre and another pool at Royal Park.

The judge said Marikar breached his position of trust and noted the matter had ended his career.

He suspended the five-year jail sentence and set a three-year good behaviour bond.
