Other:   Found with more than 12,700 child abuse images and 64 child abuse videos on three mobile phones also posted explicit images of a woman online with her personal details and rape threats. He also operated a small-scale clandestine drug laboratory in Kangaroo Flat to aid in his methamphetamine trafficking. He used social media platforms Facebook, Flickr, Twitter, Instagram and kik to transmit child abuse material.

Offence:   Pleaded  guilty to seven charges including two counts of procuring child exploitation material, committing an indecent act with a child under 16 and using a carriage service to produce child exploitation material.

Sentence:   Sentenced to three years and five months, with a non-parole period of two years and six months and placed on the Sex Offenders Register for life.

Other:   Police found a large number of images taken from under skirts of about 15 women in the Bendigo area. He also stole a USB containing photographs of children on a school camp from a primary school in central Victoria, and took his own photographs of a young child in suggestive poses.



The Court of Appeal has rejected an application from Finley to appeal his sentence.

Man jailed for 10 years

A MAN who sexually assaulted a five-year-old girl in central Victoria was sentenced yesterday to 10 years jail.

Edward John Tappe, 49, of no fixed address, befriended the child at a caravan park and in what Judge John Smallwood described as a “dreadful breach of trust,” later sexually assaulted her orally.

The offence happened late 2003. Tappe was convicted by a jury in the Bendigo County Court of one count of committing an act of sexual penetration of a child aged under 16.

Tappe will now serve a minimum of eight years behind bars, with Judge Smallwood saying the behaviour was “predatory and clandestine”. The Bendigo County Court was told Tappe had a 30-year history of sexual violence against women, including convictions for rape abduction and child stealing. In 1977, he was sentenced to five years’ jail for abducting a 29-year-old woman in Melbourne, driving her to a remote area and raping her. On another occasion, the court was told, Tappe raped a 22-year-old woman four times and allegedly drove her to St Kilda, where he suggested she prostitute herself so he could earn money. Other victims included girls aged 10, 13 and 15_ one of whom was grabbed from behind as she was entering a block of flats in Melbourne. Another was grabbed around the neck and told to lie on a bed. In sentencing Tappe, Judge Smallwood described the recent offence against a five-year-old child as “very grave.” He said Tappe was a serious sex offender who had shown a “total lack of remorse” for his actions. The court was told Tappe has spent two-thirds of his life in custody and began sexually offending as young as age 12. Judge Smallwood fixed a non-parole period of eight years.

Sex offender jailed

A JUDGE has slammed claims a man sexually abused a former girlfriend’s 10-year-old daughter because the child had approached him.Appearing at Bendigo County Court, Miguel Suparo, 47, was sentenced to three years’ jail for single counts of sexual penetration and performing an indecent act before a child under 16.Speaking outside of court, the victim’s mother said she hoped the sentence would bring closure.“I want to walk away from it now, it’s been a very long year.”Suparo told police he had fondled the girl and masturbated in front of her because she had been “sexually precocious”.“You said that she was very sexual, and that she approached you all the time,” Judge Julian Leckie said.“I make it clear that I reject this.“I am somewhat disturbed by your efforts to shift responsibility to the child and her mother,” he said.At a hearing last week, prosecutor Patrick Southey said Suparo had entered into a relationship with the girl’s mother. The court was told that on one occasion, the girl climbed into bed with her mother after suffering a nightmare and the following morning, as her mother made breakfast, the girl was assaulted in bed by Suparo.“Your conduct was most disturbing . . . the child was entitled to feel safe when she got into bed with her mother,” Judge Leckie said.“You abused this child in her home and the victims of your crime have suffered considerably.”In a victim impact statement tendered to court, the girl’s mother said her daughter used to be warm and friendly, but now feared men and suffered continual nightmares.Judge Leckie said the girl’s mother had suffered overwhelming feelings of failure at being unable to protect her child.However, he told her Suparo had acted covertly, and there was little way she could have known before her daughter eventually confided in her in April.Last week, the court was told Suparo grew up a homeless child on the streets of Argentina before moving to Australia in 1998.Judge Leckie said that while Suparo showed reasonable prospects of rehabilitation, general deterrence and the need to manifest the community’s disgust at his behaviour was significant.Suparo will be eligible for release in June 2010.Police yesterday said efforts would be made to deport him when he is out of custody.

Jail term for ‘most graphic’ child porn

A WHITE Hills man has been jailed for 18 months for downloading a collection of child pornography that detectives described as the worst and most graphic they had ever seen.

Brett Linton Pettersen, 28, pleaded guilty to possessing a collection of more than 1100 videos and images of child pornography, the majority of which depicted children under 10 years old.

He was sentenced to 18 months in prison with a nine-month non-parole period for one charge of possessing and one charge of producing child pornography.

The production charge related to Pettersen copying nude pictures of a 14-year-old Bendigo girl and her school friends that he stole from a computer he was fixing while working as an IT technician in 2007.

Pettersen was repairing the computer when he found and copied a folder full of explicit pictures the computer owner’s daughter had taken of herself and friends in various states of undress.

Detectives later uncovered the files on Pettersen’s computer in a raid on his parents’ White Hills home, where he lives.

Members of the Victorian sexual crimes squad said the collection of 1171 movies and images were the most graphic they’d seen, with some films showing children as young as a few months old.

Pettersen said he had been downloading the collection of child pornography for a number of years and that he looked at the images and movies every week.

Defence lawyer Martine  March said her client had been on a “slippery slope”, looking at material online that was increasingly graphic and intended to shock.The Bendigo County Court was told that despite breaching the trust of his employer by copying the pictures of the 14-year-old girl from a client’s computer, Pettersen had continued to be employed at Forrest Computing in Epsom.

In her sentencing Judge Wendy Wilmoth said the offending deserved a penalty that reflected the seriousness of the crime.

Ms Wilmoth said she was able to apply some leniency because of Pettersen’s lack of criminal history and her belief that he had no “paedophilic tendencies”.

Man, 56, jailed – three years’ prison after sex with teen

A RIDDELLS Creek man has been jailed for three years for having an affair with a schoolgirl.

The Bendigo County Court was told Lynton Anthony Melbourne had sex with the 15-year-old girl on a number of occasions.

The offences happened in central Victoria over a three-month period in 2004, when the man was 55.

Last week Melbourne, now aged 56, pleaded guilty to 10 charges of sexual penetration of a child under 16 and six counts of indecent act with a child under 16.

In the Bendigo County Court yesterday, Judge Jane Campton sentenced Melbourne to three years’ jail, fixing a non-parole period of 18 months.

The court was told Melbourne had been giving the girl horse riding lessons when a relationship developed between them.

Consensual sexual encounters followed, on one occasion taking place in Melbourne’s car.

The court was told Melbourne had been aware of the victim’s age at the time and knew what they were doing was wrong.

A victim-impact statement detailed in court stated that the girl now had difficulty forming relationships with boys her own age.

It revealed she felt she had lost her dignity, her school work had suffered and she “hated what Melbourne had done to her”.

The court was told that Melbourne had already spent almost a year in detention and that he had been on suicide watch and high doses of antidepressants.

Psychologists’ reports discussed in court stated Melbourne did not appear to have psychosexual problems and recognised he had made “a dreadful mistake”.

The court was told Melbourne had previously been married and had a son, aged in his 20s.

In sentencing, Judge Campton took into account Melbourne’s guilty plea, lack of prior sexual offending and the fact he was unlikely to re-offend.

“(To begin with) the relationship between you and the victim was a positive emotional relationship,” she said.

“Unfortunately, it extended into a sexual relationship.

“The victim was still a child in the eyes of the law… and this was a breach of trust.”

Grandfather destroyed childhoods

A STRATHFIELDSAYE man, who claimed his step-granddaughters ‘‘dobbed him in’’ for raping and abusing them over a period of 10 years, was sentenced to nine years’ jail this week.Kelvin Hards, 76, pleaded guilty in Bendigo County Court to two counts of rape and six representative counts of performing an indecent act.Judge Carolyn Douglas told the court that between 1995 and 2007, Hards sexually abused both girls, fondling them when they were left in his care.On two occasions, one of the girls was raped. Hards later told police he ‘‘loved them too much’’. Both girls were first abused when aged five and six.Judge Douglas said Hards became involved in the lives of his step-grandchildren when his stepson’s marriage dissolved. Alone with his own son and two daughters, Wards’ stepson relied on his mother and stepfather to help care for his children. Judge Douglas said the three children spent many weekends with their grandparents and the indecent assaults first occurred in their home in the winter of 1995, when the older granddaughter was six years old.Judge Douglas said Hards asked his granddaughter to sit on his knee. The court was told Hards rubbed his granddaughter’s genitals over her underwear, but stopped when she jumped off.The court was told on other occasions the granddaughter was made to hold her grandfather’s penis.Judge Douglas said similar incidents happened elsewhere around the home over the course of the next 10 years.On two occasions, Hards raped the then eight-year-old elder granddaughter, before telling her not to tell anyone about the incidents.The court was told that when the girls were aged 17 years and 15 years, they confided in their mother, who contacted police.Neither girl knew the other had been assaulted.Judge Douglas said Hards at times told different police officers he was only engaging in ‘‘petting,’’ and found that ‘‘one day it just started happening’’.He told police he knew his actions were wrong, but insisted his victims should have contacted police earlier, if they felt it necessary.A victim impact statement tendered to the court from the elder granddaughter, now 19 years old, heard she had suffered ‘‘a lot of emotional trauma’’.‘‘I wonder how I’m still here,’’ she writes.Suffering nightmares and flashbacks to the assaults, she told the court she gets bad memories if people tap her on the shoulder.‘‘I’ve missed out on so much already . . . my whole childhood was taken from me,’’ she said.A victim impact statements from the younger granddaughter was read out in the court at the 16-year-old’s request.‘‘I hate him for it. I want my childhood back,’’ she said.Judge Douglas said Hards had operated deliberately and under a ‘‘breach of trust,’’ describing the victims as ‘‘vulnerable young girls’’.Hards’ wife and several family members wept as he was sentenced to jail.The two victims, together with other family members, sat elsewhere in the court.Wards will be eligible for parole in six years. He has been registered as a sex offender for the remainder of his life.
