Man jailed for rape, indecent treatment of four-year-old

A 27-year-old man who digitally raped a four-year-old girl has been jailed after police found sexual images of the child on his laptop.

Damien James Hilderbrandt was found guilty of one count of rape and five counts of indecent treatment of a child in a trial last week.

On Monday, he also pleaded guilty to a second indictment of possessing child exploitation material.

He was 26 when he digitally raped the young girl and took photos of the act on his mobile phone, saving five images on his laptop.

The second indictment related to an additional 55 images and three movies which were located on his laptop.

While 51 of those images and the videos were cartoon in nature, four of them depicted real photos of pre-pubescent girls in sexual situations.

The court heard that he denied, and expressed surprise, that any images of real children would be on his computer and showed no remorse.

However, Crown prosecutor Alexandra Baker said he told police he needed help after admitting to possessing the cartoon images.

Defence barrister Ross Lo Monaco said Hildebrandt was introverted, shy and spent most of his time inside playing computer games and taking drugs before the offending and was even homeless for a while.

In March last year he was incarcerated, and Mr Lo Monaco said being in prison had transformed him from “a small weak-minded, weak-bodied addict”.

“He was angry at the beginning, now he’s almost glad he was given this opportunity to change,” he said.

“He has been trying to improve himself during incarceration.”

He was sentenced to three years and six months in jail for the rape, 18 months for each of the five indecent treatment charges and 12 months jail for possessing child exploitation material.

He has already served almost a year on remand.

The sentences will be served concurrently.

Ballarat man caught with hundreds of child porn photos avoids jail

A magistrate has been persuaded not to jail a 27-year-old Ballarat North man who was found with hundreds of child exploitation images.

Sentencing via a videolink from the Geelong Magistrates Court, magistrate Ronald Saines told Patrick Cronin the small percentage of illegal images found, combined with his clean criminal history and early plea convinced him jail was not the most appropriate action.

Cronin had earlier pleaded guilty to one count each of possessing child pornography and possessing cannabis.

In June the Ballarat Magistrates Court heard 62,340 images were found on Cronin’s laptop, with 612 images showing examples of illegal child exploitation.

A number of the 612 images included sexual activities with toddlers and pre-pubescent children.

Sentencing was deferred until Wednesday while a community corrections order (CCO) was completed.

Having read the report Mr Saines said he was persuaded not to impose a term of imprisonment.

“The offence is punishable by prison, and in some cases the courts find no alternative than to impose a term of imprisonment,” Mr Saines said.

“But in your case it can be said only a small number of images were found among the larger number of images you have downloaded.”

Cronin was convicted and sentenced to a two-year CCO with conditions to undertake 200 hours of community work and participate in a sex offender program.

He was also placed on the sex offender register for eight years.

“Not only you, but the community will benefit from the court implementing treatment and rehabilitation, rather than placing you in prison which could be unproductive,” Mr Saines said.

“Were there to be any form of repeat it is likely you will receive a substantial term of imprisonment.”

Cronin’s lawyer said her client understood he was at a point in time where he could benefit from conditions on a CCO order.

“He is more than willing to do such things,” she said.

UPDATE:  SENTENCE

On the first charge of using a carriage service to access child abuse material he was given a nine-month suspended sentence, ordered to pay a $900 bond and given two years probation.

On the second charge he was given a 12-month suspended sentence, ordered to pay a $900 bond and given 12 months probation.

Former Orange teacher who viewed child abuse material “petrified” of going to prison

A former Orange Public School teacher convicted of two charges relating to child abuse material is expected to escape going to jail.

Forty three-year-old Jarrod Johnson-Smith appeared in the Orange District Court on Thursday with his parents and gave evidence to Judge Colin Charteris regarding the charges of using a carriage device to access child pornography and possessing child abuse material.

Thirty six images found on a USB drive on Johnson-Smith’s laptop last September were tendered to the court.

The Commonwealth prosecutor Stacey Hatch said a majority of those images were ‘on the lower end of the scale’.

When asked how he felt about the seriousness of the offences, Johnson-Smith said he was “absolutely disgusted” with himself and that he had been seeking psychological treatment in Sydney.

Jarrod Johnson-Smith told the judge he was “petrified” of going to jail.

The court heard the 43-year-old searched for images of teenage boys because he was morbidly obese and he wanted to imagine himself looking like they did.

He said he wasn’t aware he was sexually attracted to children.

The judge was told the psychologist treating Johnson-Smith deemed the offender must have been receiving some sort of gratification from his actions.

Judge Charteris said he wanted to confirm whether he could impose a longer good behaviour bond in conjunction with a suspended sentence and will deliver the sentence next Wednesday.

Van park man had in excess of 500 child porn images

POSSESSING more than 500 pornographic photos of children has resulted in an 18-month suspended sentence for a Nowra man.

Christopher John William Smith, 40, of Willows Caravan Park, pleaded guilty in Nowra Local Court to owning images of child abuse.

Smith was arrested on July 2 last year after police went to his van to speak to him about possessing child pornography.

Smith showed police his laptop and they saw six photos of children around 10 years of age in suggestive poses and wearing underwear.

A search of the van uncovered seven DVDs with more photos.

Police seized Smith’s laptop, webcam, mobile phone and modem and took him to Nowra Police Station.

They viewed the discs at the station and saw photos of two young Asian girls, also about 10, completely naked and performing sexual acts on each other.

Smith admitted to owning child pornography and said he realised it was illegal.

When asked why he had it, he told police he was interested in young girls’ clothing as he collected dolls and got ideas for their fashions from the photos.
