Man jailed for rape, indecent treatment of four-year-old

A 27-year-old man who digitally raped a four-year-old girl has been jailed after police found sexual images of the child on his laptop.

Damien James Hilderbrandt was found guilty of one count of rape and five counts of indecent treatment of a child in a trial last week.

On Monday, he also pleaded guilty to a second indictment of possessing child exploitation material.

He was 26 when he digitally raped the young girl and took photos of the act on his mobile phone, saving five images on his laptop.

The second indictment related to an additional 55 images and three movies which were located on his laptop.

While 51 of those images and the videos were cartoon in nature, four of them depicted real photos of pre-pubescent girls in sexual situations.

The court heard that he denied, and expressed surprise, that any images of real children would be on his computer and showed no remorse.

However, Crown prosecutor Alexandra Baker said he told police he needed help after admitting to possessing the cartoon images.

Defence barrister Ross Lo Monaco said Hildebrandt was introverted, shy and spent most of his time inside playing computer games and taking drugs before the offending and was even homeless for a while.

In March last year he was incarcerated, and Mr Lo Monaco said being in prison had transformed him from “a small weak-minded, weak-bodied addict”.

“He was angry at the beginning, now he’s almost glad he was given this opportunity to change,” he said.

“He has been trying to improve himself during incarceration.”

He was sentenced to three years and six months in jail for the rape, 18 months for each of the five indecent treatment charges and 12 months jail for possessing child exploitation material.

He has already served almost a year on remand.

The sentences will be served concurrently.

Robert John Fardon arrested in Brisbane over alleged breach of supervision order

Convicted rapist Robert John Fardon has been arrested in Brisbane over an alleged breach of the conditions of a supervision order.

The 65-year-old has been living in community detention at Wacol in south-west Brisbane since being released in December last year

A source has told the ABC Fardon was planning to escape his home, which is under 24-hour surveillance.

He was taken into police custody this afternoon and the matter will be listed for an initial hearing in the Supreme Court as early as tomorrow.

Fardon has spent most of his adult life in prison after he was convicted of numerous sex offences against women and children.

In 2003, Fardon was the first person to be detained indefinitely under Queensland’s Dangerous Prisoners Sexual Offenders Act.

In December 2013, Attorney-General Jarrod Bleijie withdrew an application to keep Fardon in prison.

The decision came after the Court of Appeal declared sections of a new act, granting the Attorney-General power over sex offenders, was invalid.

Fardon’s supervision order was issued under the provisions of the Dangerous Prisoner (Sexual Offenders) Act 2003.

Offence:  Pleaded guilty in the Mackay District Court to one count of making an objectionable computer game and two counts of possessing objectionable computer games.

Sentence:  Sentenced to a wholly suspended three months’ jail.

Other:  Police found 225 photographs of naked girls aged between eight and 12 which had been purchased over the Internet and burned on to a compact disk, 281 pornographic images and 16 movies downloaded on to the computer.

Marcel Schauer

UPDATE:  AUGUST 2017

Schauer has been charged with contravening two offender prohibition orders between May 5 and November 13, 2015.

He’s also been accused of failing to comply with reporting conditions on June 1 this year and committing public nuisance on April 19.

He is yet to enter pleas to those charges.

 

UPDATE: While on probation, Schauer entered a home while the owner was away and stole $600 worth of jewellery. For that offence he was ordered to do 130 hours of community service

A man has been sentenced to three years probation for attempting to rape a 13-year-old boy in Mackay in north Queensland.

In May this year, Marcel Schauer attempted to rape the boy outside a shopping centre in Andergrove.

He pleaded guilty to the charge in the District Court in Mackay on Friday, but Judge Julie Dick adjourned sentencing until today.

In handing down her verdict, she told the court it had not been easy to sentence Schauer because the crime was serious, but because of his ‘borderline intelligence’ Schauer did not understand what he had done.

She agreed with doctors’ reports that jailing Schauer would not help to rehabilitate him and sentenced him to three years parole, which is the maximum sentence.

She told the court she had done what she could to protect the community.

Ex-Stannies priest jailed

A FORMER priest at St Stanislaus’ College has been sentenced to 15 months’ jail after pleading guilty to four counts of gross indecency with a male under the age of 18.

Fr Kevin Francis Phillips was sentenced by Judge Hock in the Sydney District Court on April 21 after pleading guilty to the four charges on December 3 last year.

A suppression order was placed on Phillips’ matter by Judge Hock on April 21 preventing any publication in relation to the matter until the conclusion of former college headmaster Peter Dwyer’s trial.

Mr Dwyer was acquitted of all charges on Monday.

Phillips’ charges related to incidents at the school in 1990 when he was the chaplain.

At the time, the priest was responsible for the pastoral care of staff and students and was involved in the school’s tutoring program.

When charges were laid Phillips was practising as a priest in Mackay in Queensland. He had left the Vincentians and had joined another order.

Phillips, now in custody, was sentenced on four counts of gross indecency with a male under 18.

On the first three counts he was sentenced to a concurrent term of imprisonment of nine months starting on April, 21, 2011 and expiring on January 20, 2012.

Judge Hock said no non-parole periods were set as no useful purpose would be served by doing so.

On the final charge of gross indecency by a male with a male under 18 years Phillips was sentenced to a term of imprisonment of nine months to start on October 21, 2011 and expiring on July 20, 2012 with a non-parole period of three months.

Pursuant to Section 51 of the Crimes (Sentencing Procedure) Act Judge Hock also directed the offender’s parole not to be subject to supervision, entitling him to return to Queensland on his release.
