Rape victim wins $139K compensation

A County Count judge has ordered a convicted rapist to pay more than $139,000 compensation to his victim.

50-year-old William Craig Forde was sentenced to an indefinite term in jail last year.

The court was told he kidnapped a woman identified as “Jessica” in Ballarat in 2006.

He held her captive in her car for almost 30 hours and repeatedly raped her.

Judge Tom Wodak said he accepted “Jessica” suffered Post Traumatic Stress Disorder as a result of the attack.

Despite being ordered to pay compensation, Forde may not be able to pay the full amount.

His only asset is a rural block of land, that may have to be sold to pay his legal fees.

His prison term will be reviewed in 16 years.

Jessica’s lawyer Katalin Blond says now the compensation order has been made, steps have to be taken to enforce it.

“Jess is grateful in the acknowledgment of the court’s judgement but understands that there’s certainly a long road ahead in enforcing that judgement,” she said.

“I would imagine that that issue probably won’t be resolved for at least 12 months.”

Court gives life term to ‘depraved’ rapist

A man who repeatedly raped a woman from Ballarat, in central Victoria, will spend the rest of his life in jail.

The 29-year-old woman was kidnapped and raped at knife-point over a 30 hour period in February, in at attack Detective Paul Jolly of Ballarat police says is the worst he has seen in 24 years.

“This would have to be the nastiest incident I’ve dealt with,” he said.

William Craig Forde, 49, was today sentenced in the County Court in Ballarat to an indefinite jail term.

Judge Wodak said the offences were of a gravity rarely seen, and Forde showed little potential for reform.

The victim described Forde as an animal.

“As much as you can characterise somebody like this, then that’s the way to say it, depraved, deviant,” she said.

She says she will try to use her experience to help other rape victims.



Criminal history of William Craig Forde:

September 8, 1988 — raped a 31-year-old woman neighbour at knifepoint in her
Thornbury home. Forced her to drive him to a primary school where her children
were waiting, but she was able to escape and call police.

June 1, 1989 — convicted in the County Court of two counts of rape, indecent
assault, intentionally causing injury and car theft. Sentenced by Judge Cullity
to a maximum five years’ jail with a minimum of three years.

August 24, 1990 — released from jail after remissions of one- third off the
sentence for good behaviour, which were then applicable.

June 20, 1991 — aggravated rape at knifepoint of a woman who had come to his
outer suburban home to pick up some ironing. The 57- year-old woman was punched
in the face and had her wrists and ankles tied with twine during the attack,
which lasted more than 30 minutes. She escaped by locking herself in her car
after he ordered her to leave the house with him and said he was “taking her
for a ride”.

November 15, 1991 — convicted in the County Court of aggravated rape,
aggravated indecent assault, intentionally causing injury and false
imprisonment. Sentenced by Judge Stott to 10 years’ jail with a minimum of
seven years.

November 26, 1996 — refused parole because of his unwillingness to participate
in a sex offenders’ treatment program in jail.

July 11, 1997 — again denied parole.

March 24, 1998 — released from jail on expiry of his maximum sentence (less
remission of one-third, which applied when he was sentenced in 1991 but was
abolished the following year).

September 28, 1998 — raped a 13-year-old girl, who was attacked when Forde
took her for a walk at Whittlesea after driving down a dirt track and leaving
his partner in the car. Forde was arrested six weeks later at a Queensland
caravan park.

September 30, 1999 — convicted of rape and sentenced in the County Court by
Judge Stott to a maximum of seven years’ jail with a minimum non-parole period
of five years, including 326 days already remanded in custody.

September 18, 2002 — told he would not be paroled when his minimum sentence
expired because he refused to do the sex offenders’ program.

November 19, 2003 — denied parole.

December 1, 2004 — again denied parole.

August 4, 2005 — refused parole again.

November 7, 2005 — released from jail on expiry of his maximum sentence.

February 6, 2006 — raped a young shop assistant in the back of a Ballarat shop
after tying her wrists and ankles behind her, gagging her and cutting off her
clothes with a knife. Forde then stole the 23-year-old mother’s car, bundled
her into it at knifepoint and drove her around central and northern Victoria
for the next 29 hours. She was raped repeatedly during her ordeal before being
driven back into Ballarat and let out of the car.

May 12, 2006 — appeared at Ballarat Magistrates’ Court for a preliminary
hearing and said he was guilty of 22 counts of rape and two charges of armed
robbery, one of abduction and one of false imprisonment.

Man jailed for procuring child sex on Internet

A Brisbane judge has jailed a 56-year-old Maryborough man who pleaded guilty to using the Internet to procure a child for sex.

Gordon James Randall also admitted possessing child abuse images.

The District Court heard Randall used an Internet chat room in 2003 to talk to a police officer posing as a 13-year-old girl and it was not long before the topic turned to sex.

Randall sent the officer several pornographic images before arranging a meeting on Brisbane’s north side where he was arrested.

Police also seized his home computer and 200 pornographic images, including photos of young children engaged in sexual acts with adults.

Judge Julie Dick told Randall his behaviour was insistent and aggressive and jailed him for 18 months but suspended the term after three.

Jail term for Chev teacher

A FORMER Chevalier College teacher was sentenced to 18 months in prison when he appeared at Goulburn District Court last week for the sexual abuse of three male students between 1983 and 1991.

Brian Walter Napper, formerly of Moss Vale, was convicted of two charges of sexual assault and one charge of aggravated indecent assault after pleading guilty to all three counts in May.

The 64-year-old’s 18-month jail sentence included a non-parole period of eight months beginning from the sentencing date (October 27).

LEADING forensic psychiatrist Alan Bartholomew warned in 1975 that paedophile Raymond Kenneth Jones had a problem with boys and the propensity to murder.

Dr Bartholomew twice interviewed Jones in prison after Jones was charged with indecently assaulting a young boy in a Ballarat toilet block.

Jones admitted to Dr Bartholomew he had been having inappropriate sexual urges “on and off ” during the previous eight years, “mainly when pushed aside by girls and things like that”.

Dr Bartholomew said Jones had threatened his young male victim by saying “keep quiet or I’ll hit you”.

“It is impossible to guess what might have happened if the boy had made a noise,” Dr Bartholomew’s report on Jones said.

“But a more serious assault could have occurred, and possibly murder.

“This is a real possibility as the prisoner claims that his nerves are bad and that he loses control.

“The fact must remain that the prisoner is potentially dangerous and likely to remain so for some time.”

Dr Bartholomew provided his report on Jones to a County Court judge exactly a month after Terry Floyd, 12, disappeared while on his way home to Maryborough from nearby Avoca.

Jones was out on bail when Terry disappeared on June 28, 1975.

Jones was later convicted of indecently assaulting the boy in the Ballarat toilet block and was jailed for two years.

While Jones was one of many men interviewed soon after Terry disappeared, he was initially not considered a serious suspect.

That was largely because police and Maryborough locals were convinced another convicted paedophile, Francis Robert Drake, the son of the Maryborough mayor at the time, had abducted, sexually assaulted and killed Terry.

It wasn’t until homicide squad detective Ron Iddles reinvestigated Terry’s disappearance, while preparing for Terry’s 2001 inquest, that Drake, who died in 1991, was eliminated as a suspect and Jones firmed up.

Jones drove a fawn Holden panel van at the time Terry disappeared and has admitted being on the Pyrenees Highway, travelling from Avoca to Maryborough, at the time.

Three witnesses have told police they saw a vehicle similar to Jones’s panel van near the hitchhiking boy.

Jones, 58, recently told the Herald Sun he had nothing to do with the disappearance.

Jail for child sex abuser who fled

A CHILD molester who fled during his trial and was on the run for almost three years has been jailed by a District Court judge.

Allan James Hunt, 44, was found guilty by a jury of four counts of indecent assault and one count of unlawful sexual intercourse against an eight-year old girl in 2003.

When the jury retired to consider its verdict, Hunt fled the state and was not recaptured until March this year at Maryborough in country Victoria.

The court heard Hunt had formed a new relationship there with a woman who had two young daughters.

Hunt’s new partner and her children wrote him references and the court heard there were no allegations he had behaved inappropriately against them.

Hunt’s partner was in court today as Hunt was sentenced to a total of five years prison.

Chief Judge Terry Worthington said Hunt had performed a sex act on the eight-year-old at the child’s grandmother’s house.

“It is clear from the victim’s statement that she suffers greatly for what has happened and her grandmother is also shattered that it happened under her care,” he said.

“You abused this child for your own sexual gratification … what you did was a gross breach of trust.”

With time already served on remand, Hunt will be eligible for parole in two years and four months.

Man found with 9700 child porn images

TO FAMILY, friends and neighbours, Maryborough’s Christopher Bruce Elliot probably appeared to be an ordinary, respectable resident.

Divorced but in full-time employment, the mature-aged father kept a low profile at his Granville home.

But, of course, things are not always as they appear and it was during a police raid in April last year detectives uncovered the 53-year-old’s sordid double life.

Police seized from Elliot’s house more than 9700 child pornography images off three computers and six DVDs containing 24 child pornography movies.

Of all the images, 7964 contained pubescent and pre-pubescent children in “sexual poses”.

The rest included pictures of young children engaged in sexual activity, being penetrated or exposing themselves.

Two of the pictures came under the category of “torture, cruelty or bestiality”.

The video files also included scenes of children being penetrated but one in particular was a montage of a number of children giving and receiving sexual acts and bondage scenes.

Elliot pleaded guilty in the Maryborough District Court to nine charges of possessing child exploitation material.

He left the courthouse in handcuffs after being sentenced to two years imprisonment, suspended after three months, by Judge Michael Noud.

“The courts and community are very concerned about this type of offending,” he said.

The court heard Elliot – who had been convicted in the past for an indecent assault – had been suffering chronic depression and anxiety since he was arrested in April last year.

Defence counsel Mark Dixon said Elliot had had to sell his house and flee to Victoria because he was targeted after he was “named and shamed” in the Chronicle.

“He sold his property and has been residing in Victoria in fear of remaining in Maryborough,” he said.

Cooper pleaded not guilty in Geelong Magistrates’ Court on Wednesday to four charges of failing to comply with the Victorian Sex Offenders Register.

Magistrate Lesser found the charges proved and sentenced Cooper to two months jail to be followed by a six month Community Corrections Order.

He was later released on bail after lodging an appeal against sentence.

‘Sheer filth’: judge sprays online groomer

A judge has described as ‘‘sheer filth’’ the crimes of a Victorian man who assumed the online alias of a 14-year-old to groom children for sex.

Bryan Cooper, 25, of Maryborough, pretended to be a teenage boy in the MSN Messenger chat room to discuss sex acts with children.

Among the lewd acts Cooper outlined was a discussion about a suspension from school for having sex with an 11-year-old.

He also used the alias to convince two boys to masturbate in front of their web cameras.

Australian Federal Police officers traced child pornographic images Cooper sent to children and adults via the chat room between December 2006 and July 2010.

Police found 60 child porn images and 31 videos in a raid on his central Victorian home in November 2009.

Cooper pleaded guilty in the Victorian County Court to nine child sex charges including knowingly possessing child pornography and using a carriage service to groom a person under 16.

Judge Lance Pilgrim on Monday sentenced Cooper to seven years’ jail, identifying a ‘‘sophisticated degree of planning’’ in his crimes.

‘‘These offences … are disgusting in nature and context and are to be denounced in the strongest terms,’’ the judge said.

Judge Pilgrim also noted psychologist reports which questioned Cooper’s level of remorse for his crimes.

‘‘Your future rehabilitation depends on coming to grips with the serious nature of your offending,’’ the judge said.

Judge Pilgrim acknowledged Cooper’s guilty plea but said the fact he had re-offended while on bail was an aggravating factor.

Just months after his first appearance on the charges in Bendigo Magistrates Court, Cooper ignored the bail condition to stay off the internet and reactivated his alias account.

Cooper’s barrister Kyle McDonald said his client displayed some symptoms of Asperger’s syndrome.

Mr McDonald said the number of images and videos stored on Cooper’s computer was ‘‘not toward the upper end of the scale’’ in context to other offenders.

Cooper will serve a minimum of five years.

Guilty plea entered on child porn

A MARYBOROUGH man who had accused police of planting evidence of child pornography at his home has pleaded guilty to seven charges including using the internet to groom a child for sex.

Bryan Cooper, 25, pleaded guilty to the charges in the Bendigo County Court yesterday.

No evidence was heard before Judge Lance Pilgrim and no application for bail was made.

Cooper will be held in custody until a plea hearing in the same court on December 17.

During a committal hearing in the Bendigo Magistrates Court earlier this year, Cooper accused members of the Australian Federal Police of planting evidence of child pornography at his home when they raided it in November last year.

The court also heard accusations that Cooper had used an internet chat service to groom young girls for sexual activity and used the web to download and transmit child pornography.

An A4 image of a naked child was also found in a desk drawer at his home.

Cooper was charged with those offences in November and was released on bail, with strict conditions prohibiting him from accessing the internet.

The court heard that 10 months later he was again arrested after continuing to log onto the internet, grooming girls for sex.

He has been held in custody since that arrest in August.

In the County Court yesterday Cooper pleaded guilty to seven charges, including using a carriage service to access and transmit child pornography, using a carriage service to procure a child under the age of 16 and knowingly possessing child pornography.
