Offence:   Pleaded  guilty to seven charges including two counts of procuring child exploitation material, committing an indecent act with a child under 16 and using a carriage service to produce child exploitation material.

Sentence:   Sentenced to three years and five months, with a non-parole period of two years and six months and placed on the Sex Offenders Register for life.

Other:   Police found a large number of images taken from under skirts of about 15 women in the Bendigo area. He also stole a USB containing photographs of children on a school camp from a primary school in central Victoria, and took his own photographs of a young child in suggestive poses.



The Court of Appeal has rejected an application from Finley to appeal his sentence.





Man jailed for 13,000 child-porn images

A MAN police caught with more than 13,000 child pornography images has been jailed.

In the Supreme Court, in Burnie, on Thursday, Aaron Luke Dooley was sentenced to 10 months’ jail, with six months of that suspended on condition he commit no offence punishable by jail for three years.

Chief Justice Alan Blow also ordered Dooley be placed on the sex offenders’ register for 10 years and imposed an 18-month probation order.

Dooley had told a probation officer he had no current sexual interest in children, and had been unable to explain why he had the images, the judge said.

Dooley had pleaded guilty to possessing, accessing and distributing child-exploitation material.

Justice Blow said Dooley had admitted he had been downloading and looking at the material for two years.

Of the images, more than 13,000 were of children in sexually suggestive poses and some other images were in more serious categories.

Accessing and possessing such material was treated very seriously, the judge said, because of the terrible harm which was done to sexually abused children.

Dooley distributed some of the material via internet chat rooms to people he did not know.

Man jailed for raping 75-year-old

A Victorian man who raped a 75-year-old woman in her home has been jailed for 14 years for the cowardly and depraved crime.

Jason Jude D’Souza, 39, broke into the elderly woman’s home and attacked her, only saying ‘I have not been here’ when she told him she was having difficulty breathing.

Victorian County Court Judge Mark Dean said a message must be sent to the community that courts would protect the elderly, as he sentenced D’Souza to a minimum 10 years’ jail on Wednesday.

‘You must also be punished for what you have done and your cowardly, depraved conduct must be denounced by this court,’ he told D’Souza.

Judge Dean said D’Souza had shown no remorse and still denied raping the woman, who was deeply traumatised by what happened.

‘Her sense of trust and wellbeing has been irreparably harmed by what you did,’ he said.

‘She has not revealed what has happened to her to her own children, and no doubt continues to suffer from the effects of what you did.’

The court heard D’Souza suffered from depression and had been undergoing testosterone replacement therapy, with relatives reporting aggressive behaviour as a result.

One psychological report before the court said D’Souza had spiralled into a state of personal crisis due to his infertility and a failed relationship, and his offending towards his unwilling and vulnerable victim was an attempt to reinforce his sense of personal strength.

Judge Dean said he accepted D’Souza was experiencing some side effects of the therapy at the time of the October 2013 rape, and took that into account.

D’Souza will be placed on the sex offenders register for 15 years.

He was found guilty at trial of seven counts of rape, and one count each of indecent assault and aggravated burglary.

Reigstered sex offender Raymond Dean jailed for assaulting 12-year-old girl

A REGISTERED sex offender, who indecently assaulted a 12-year-old girl and failed to comply with the Sex Offenders Register, has been jailed for 18 months.

Raymond Dean was ordered to serve nine months before being eligible for parole but was later released after lodging an appeal against his sentence.

Dean, 50, of Long Gully, Bendigo, pleaded guilty in Geelong Magistrates’ Court yesterday to charges of indecently assaulting a child under 16 and failing to comply with the Sex Offenders Register.

Police prosecutor Sergeant Glenn Abbott said that in 2012 Dean was temporarily staying at the victim’s home.

“The victim was asleep in her bedroom one evening when she woke to find Dean squeezing her breasts,” he said. “The victim told him to get out and he left.

Sgt Abbott said that, later the same night, the girl woke to find Dean had returned to her room and was kissing her on the lips.

“Again she told him to get out,” the prosecutor said. “On another occasion the victim went to sleep on the couch in the lounge room and woke to find Dean’s hand up her top, rubbing her back.”

The prosecutor said the victim told her mother, who came into the room and sat with them for a while before going back to bed.

“The victim said she felt sickened by Dean’s behaviour,” he said.

Sgt Abbott said Dean, who has been on the Sex Offenders Register since 2010, failed to disclose to police, that he was living in a house where children were present and that he had purchased another car.

Chris Terry, for Dean, said his client had priors for indecent assault and failing to comply with the Sex Offenders Register.

Mr Terry said Dean was a chronic alcoholic, that all the adults in the house at that time were heavy drinkers and he had little memory of events.

Magistrate Ian von Einem convicted Dean on both counts and sentenced him to 18 months in jail with a non-parole period of nine months.

Man jailed over sex with girl

A MAN who had sex with a teenage girl who subsequently became pregnant and had a termination will spend five months in jail.

Chris Douglas Stephens had pleaded guilty to one count of sexual intercourse with a young person under the age of 17 years.

Passing sentence in the Supreme Court yesterday, Chief Justice Ewan Crawford said the offence occurred on May 29 last year when the girl was 15 years old and Stephens was 37.

Justice Crawford said Stephens had become a friend of the girl and her family and she and her sister came to his home to play with a puppy and to watch cable television.

The judge said the girl’s parents trusted Stephens as a friend because he had a daughter of the same age.

However, on May 29 Stephens and the girl ended up in his bed and had consensual sex.

The girl became pregnant and Stephens admitted what had happened to her parents.

However, when police became involved he denied having had intercourse. He continued his denials until evidence was produced to show he was the father of the unborn child.

“He pleaded guilty once he had been charged. It is said he demonstrated remorse to her family but he did not demonstrate it to police and I accept the submission by counsel that the plea of guilty came about in recognition of an overwhelming case against him,” Justice Crawford said.

It did not serve as a mitigating factor that Stephens had been suffering from depression.

“He had a responsibility as an almost middle-aged man not to have a sexual relationship with a child aged 15,” he said.

It was also significant that the girl became pregnant and underwent a termination.

“I would have more regard to a submission that no actual imprisonment should be imposed if that had not occurred, but the impact of the crime, its consequences, have to be taken into account and in my view the only sentence that is appropriate is one of actual imprisonment,” Justice Crawford said.

He sentenced Stephens to five months in jail and ordered that his name be placed on the sex offenders’ register.

Offence:  Pleaded guilty to one count of indecent assault and one count of perverting justice.

Sentence:  Jailed for three months and ordered he be placed on the sex offenders’ register for two years on his release.

Other:  Guerra was a hostel manager when the young woman was working in a nearby business and staying at the hostel. After being charged, Guerra went to the victim’s workplace and spoke to the owner, to persuade the young woman to drop the case.

Wendouree man jailed over child porn

A man has been sentenced to 15 months in prison for possessing and transmitting nearly 15,000 images and almost 400 videos of child pornography.

The County Court, sitting in Ballarat, heard Lee Terrence Clarke, 42, from Wendouree, pleaded guilty to using a carriage service to look at and share the images between April and October 2012.

The judge said it was entirely appropriate that Clarke had lost his job as the commanding officer at the Army cadet unit of the Sebastopol College.

Clarke will be eligible for parole in nine months.
