Offence:  One count of possessing child pornography, and one count of possessing child pornography depicting a child aged under 14 years

Sentence:  One year suspended sentence on condition Webster obey a $50 good behaviour bond for 18 months. 

Other:   The prosecutor said the videos were not isolated offences as Webster’s internet search history showed he had previously accessed similar material. The offences were committed around the same time as Webster was working as a Santa Claus at Southgate Plaza in Morphett Vale. He stood trial in the District Court charged with five aggravated counts of indecent assault at Southgate Plaza in Morphett Vale and Kalara Reserve in Davoren Park in December 2012 & was found not guilty.

UPDATE:  AUGUST 2017

Schauer has been charged with contravening two offender prohibition orders between May 5 and November 13, 2015.

He’s also been accused of failing to comply with reporting conditions on June 1 this year and committing public nuisance on April 19.

He is yet to enter pleas to those charges.

 

UPDATE: While on probation, Schauer entered a home while the owner was away and stole $600 worth of jewellery. For that offence he was ordered to do 130 hours of community service

A man has been sentenced to three years probation for attempting to rape a 13-year-old boy in Mackay in north Queensland.

In May this year, Marcel Schauer attempted to rape the boy outside a shopping centre in Andergrove.

He pleaded guilty to the charge in the District Court in Mackay on Friday, but Judge Julie Dick adjourned sentencing until today.

In handing down her verdict, she told the court it had not been easy to sentence Schauer because the crime was serious, but because of his ‘borderline intelligence’ Schauer did not understand what he had done.

She agreed with doctors’ reports that jailing Schauer would not help to rehabilitate him and sentenced him to three years parole, which is the maximum sentence.

She told the court she had done what she could to protect the community.

UPDATE:  JUNE 2016

Crosswell will remain in jail indefinitely after the Brisbane Supreme Court heard he had not undertaken any sexual offender programs during his prison sentence. Three psychiatrists unanimously declared he was unfit to be released.

 

UPDATE: DECEMBER 2014

Crosswell pleaded guilty in the District Court to child sex charges after he was arrested for attempting to groom a young boy through Facebook.

The Judge took into account the 699 days Crosswell had spent in custody & set an immediate parole eligibility date.

Cop posed as child in cyber sting

A BUNDABERG man made sexual advances to an eight-year-old boy online, sending him pornographic images and discussing a meeting – only to find he was in fact talking to a police officer.

Prosecutor David Nardone yesterday told Bundaberg District Court that Adam Lee Murray Crosswell, 25, had only been out of jail for a week when he contacted a woman via her travel blog asking if she would put him in contact with her eight-year-old son.

The woman immediately became concerned and contacted police, who then set up fake online communication accounts in her son’s name.

“A police officer posed as an eight-year-old child and responded to Mr Crosswell,” Mr Nardone said.

“That communication was in the form of emailing or MSN chats.”

Mr Nardone said Crosswell asked the child to masturbate, and sent him two images of naked children and a naked adult.

“I see that in the statement of facts, he…asked the child what he thought about meeting, (which) seemed like an aspect of grooming with intent for abuse to occur,” Judge Michael Rackemann said.

Crosswell pleaded guilty to possessing child exploitation material, using electronic communication to procure a child under the age of 12, two counts of using electronic communication to expose a chid under 12 and one count of burglary and stealing.

The court heard the stealing was an offence in 2009, in which Crosswell took $7000 worth of cash and goods in Brisbane.

Defence barrister Kim Bryson said her client was the victim of physical and sexual abuse from (the ages of 11-14) by staff and other children at BoysTown.

She said the defendant suffered from attention deficit hyperactivity disorder (ADHD) and post traumatic stress disorder as a result of the abuse and a car crash he was involved in, in which a friend had died.

Judge Rackemann sentenced Crosswell to 18 months jail, to be suspended after six months with an operational period of three years.

After he is released from jail, Crosswell will also be on probation for three years.
