Music teacher with stocking fetish jailed for five years for indecently recording students

A music teacher with a fetish for stockings has been sentenced to five years’ jail for indecently recording dozens of his young students at West Australian schools.

Christopher Ryan Jones, 32, mostly used an app on his mobile phone to secretly record the 40 female victims, who were aged between six and 15, over a three-year period.

Many of the recordings were made during music classes or at recess at the schools in WA’s south and south east where he was teaching.

He also admitted to indecently recording a six-year-old girl in a supermarket and an 11-year-old at a scout jamboree.

Jones was caught when he left one of his phones at school and a teacher discovered the recordings and reported him to the deputy principal.

A search of his home then uncovered thousands of child exploitation images on electronic devices.

The District Court was told Jones had a fetish for stockings and tights, and the recordings focused on the girls’ legs and upper thighs.

He later transferred them onto a computer and viewed them for his own sexual gratification.

On two occasions he set up a hidden camera in a school storeroom and recorded students changing their clothing.

Offences ‘cunning’ but not worst of their kind, judge says

Chief Judge Kevin Sleight said those offences involved “some planning” and were particularly “cunning”.

He also said that over time, Jones had become more “confident and brazen” because he had regularly placed his phone on the ground to record the victims’ legs.

Judge Sleight said Jones’ offences were serious because they had the effect of undermining the confidence parents have in schools and made it more difficult for male teachers to be trusted.

However, he said Jones’ offending was “far from the worst of its kind” saying he had not touched his victims who were mostly fully clothed with their legs covered by the tights or stockings.

Judge Sleight also took into account Jones’ pleas of guilty to the 60 charges against him, saying it had avoided the need for 40 children to come to court to give evidence.

Jones will have to serve three years before he can be released on parole.

With time already served, his earliest release date is August next year.

WA priest jailed for sex offences

A CATHOLIC priest will spend at least 11 months behind bars after being convicted of abusing a West Australian teenager more than 30 years ago.

GLENN Humphreys, 61, was found guilty of abusing a boy between 1983 and 1986 when the boy was aged 15 to 17.

A District Court jury found Humphreys guilty of four counts of unlawful and indecent assault, but acquitted him of carnal knowledge against the order of nature.

During sentencing submissions on Wednesday, defence lawyer Seamus Rafferty argued there was an “immature context” to the offending rather than any form of grooming.

Mr Rafferty said his client was struggling with his sexuality at the time and there was an “adolescent quality” to the hugging and touching that made the case “exceptional”.

“There clearly was a fondness between these two people,” he said.

Mr Rafferty said his client was “deeply remorseful” and had engaged in rehabilitation, which Judge Philip Eaton accepted.

Judge Eaton also accepted that Humphreys was a low-risk of re-offending but said the pair formed a “grossly inappropriate” relationship and general deterrence was important.

He sentenced Humphreys to 22 months in prison, with a minimum of 11 months before he will be eligible for parole.

Priest guilty of assault on teen

A Catholic priest has been found guilty of sexually abusing a teenage boy on church property in Perth 30 years ago.

Glenn Humphreys was accused of abusing the teenager between 1983 and 1986 while he was assistant priest at a church in Perth’s south.

After six hours of deliberation, a District Court jury last night convicted Humphreys of four counts of unlawful and indecent assault.

He was acquitted of carnal knowledge against the order of nature.

The court was told Humphreys had assaulted the boy in the church’s presbytery and in a bathroom at a nearby primary school.

He admitted having an “inappropriate” sexual relationship with the boy but argued their actions were consensual.

Giving evidence this week, Humphreys said he accepted he took advantage of a vulnerable young person.

He admitted he started to feel a sexual attraction to the boy in the second half of 1985, shortly before he took him to Quinns Rocks for a holiday.

“It didn’t dawn on me at the time that there was anything unusual with that,” he said.

“It was only a little break from the parish, that’s all.”

His victim, now aged 45, lives overseas but came to Perth to give evidence.

The man told the court one of the hardest things he had done was reporting the abuse to police in 2012.

He said the abuse left him confused and shocked, describing some of the incidents as “highly traumatising”.

Humphreys moved to Perth in January 1983 after a stint at an Eastern States school.

Two men who were allegedly abused by Humphreys at the school in the mid-70s and early 80s also gave evidence during the trial.

The men testified Humphreys would put on music, often by his favourite artist Barbra Streisand, before touching them inappropriately.

Two years ago, Humphreys sent his Perth victim a letter of apology and asked for his forgiveness.

Prosecutor James Mactaggart said Humphreys blatantly abused his position of trust.

Humphreys will be sentenced on October 15.

Man used fake Facebook profiles to dupe underage girls into sexual behaviour

A West Australian man who used fake Facebook profiles to ask several underage girls to engage in sexual acts and send naked pictures has been jailed.

Leo Nayda, 25, earlier pleaded guilty to six counts of exposing underage girls to indecent matters.

Albany District Court heard Nayda, from Gnowangerup, used fake Facebook profiles to dupe the girls while on a suspended prison term for similar offences.

The court was also told he did not report his telephone numbers to his supervising officer, as required, in a bid to avoid detection.

Nayda contacted five girls, aged between 12 and 14, and one police officer posing as a 13-year-old girl, asking them to send him naked pictures or engage in sexual acts in 2012 and 2013.

Sentencing Nayda to 32 months in jail, Judge Gillian Braddock described the offences as “perverting and frightening”.

Judge Braddock said Nayda was a “very lonely man” who was afraid of people rejecting him, and that he would say the right things while doing the wrong things.

Noting that Nayda suffered from a mental impairment and social isolation, she said she did not believe he would have gone through with any physical sexual abuse.

Judge Braddock imposed a 12-month sentence for the new offences, with an additional 20 months for the crimes Nayda had earlier received a suspended jail term for.

Nayda will be eligible for parole in September 2015.

Paedophile to be monitored on release

A 65-year-old paedophile will be closely monitored by West Australian authorities for the first year of his release into the community.

Otto Darcy-Searle was released from custody last month after serving a sentence for hundreds of sex offences against four boys between 1977 and 1983.

In the Supreme Court in Perth today, Darcy-Searle was placed on a 12 month supervision order.

He is also required to report regularly to authorities and will not be allowed to travel or change his appearance without permission.

Paedophile ‘little hope of reform’

PAEDOPHILE Jayme Regulski will serve three years in the juvenile justice system, with a judge telling him he would never again avoid adult jail.

Judge Marilyn Harbison told Regulski, 20, in the County Court at Wodonga yesterday he was a clear danger to the community, and urgently needed treatment, although she had doubts about his ability to reform.

Regulski pleaded guilty to two Commonwealth counts of causing child pornography material to be sent to him over a carriage service and one Victorian count of possessing child pornography.

Regulski had begun to procure pictures of naked boys even while awaiting sentence by Ms Harbison on other sex charges in 2011.

He carried out the crimes from his Wodonga home against a boy, 14, in Queensland and a West Australian boy, who was soon to turn 11.

One Commonwealth charge related to incidents between August 14 and September 17, 2011, and the other between July 7 and August 26 last year.

The Queensland boy was lured by Regulski’s false Facebook profile in early 2011.

A stream of messages flowed between the pair before Regulski asked the boy for naked photos of himself.

Regulski did not hide his identity from the boy, 10, in Western Australia, who he met while playing games online.

He harassed the boy to send photos of himself in his underwear, and then naked, promising he would give him credits to play games online.

The offences took place while Regulski was awaiting sentence by Judge Harbison on other child sex matters from September and October, 2010.

“Eighteen months ago I sat here and you sat there in the dock,” she told him yesterday.

“You are very lucky you are of an age when this disposition in a juvenile facility is available to you.

“You will not be offered such a lenient disposition again.”

Judge Harbison urged him to engage in treatment and said any unsuitable behaviour in custody could result in him being sent to an adult jail.

“At a young age, you have a significant history of sexual offences,” she told him.

“There is no alternative for you but to change.”

Man jailed after ‘quest for sexual enlightenment’

A retired West Australian bureaucrat who downloaded 265,000 images of child pornography was sentenced to 26 months’ jail after a judge rejected his defence that he had been on a journey of sexual enlightenment.

Ernest Sydney Hulbert, 66, pleaded guilty to two charges of possessing child pornography arising from Operation Auxin, a national crackdown on child porn that led authorities to raid his home in September.

Western Australia District Court Judge Allan Fenbury sentenced the former general manager of the Kimberley Health Service to 26 months in jail, with a minimum 13 months before he is eligible for parole.

Judge Fenbury said the case was among the most serious of its kind.

The court was told Hulbert had four DVDs containing child pornography and also had a pornographic movie of a boy in various sexual poses.

The DVD images, which had been downloaded from the internet and divided into categories and sub-categories, showed children, some believed to be aged under five years, in sexual positions and engaged in sexual acts with adults. Other images simply showed naked children standing alone.

Judge Fenbury said some of the seized material was hard-core porn, depicting children suffering “gross abuse and exploitation”.

“It is sickening looking at it, and how a man who has had his own children can look at it I struggle to comprehend,” Judge Fenbury said.

He rejected the view of a clinical psychologist, outlined in court by Hulbert’s lawyer Mark Andrews, that the images were not downloaded for sexual gratification.

“My client’s instructions to me and to the psychologist are that his motive for possessing the material was not one of sexual gratification, rather a journey of enlightenment and understanding of his own sexuality and human sexual relationships,” Mr Andrews said.

He said Hulbert had become withdrawn and isolated after his 2001 conviction for importing and possessing books of child porn fiction, and had been denied a sexual relationship following the breakdown of his marriage in 1991.

Mr Andrews said two reports from the psychologist had not found any evidence of a “live interest” in children, and added Hulbert had downloaded the files without knowing how many images each contained.

However, prosecutor Sean Stocks said Hulbert had subscribed to a child porn website and had invested significant time sorting the images.

“He was paying, your honour, for the abuse of children,” Mr Stocks said.

The prosecution had sought a sentence approaching the maximum of five years, but Mr Andrews appealed for leniency for his ailing client, after conceding a jail term was the only appropriate punishment.

Outside court, Detective Senior Constable Graeme Barry described the images as disgusting, and sent a message that such crimes would not be tolerated.

“The court and the community are sending out a clear message to these sort of people that if they’re going to be involved in this sort of disgusting criminal activity, at the end of the day, the message is that if you get involved in it we’re going to catch you … and you’re going to go to jail,” Detective Barry said.

Former bureaucrat jailed over child porn images

A former senior Western Australian bureaucrat has been jailed for 26 months for possessing more than a quarter of a million images of what have been described as sickening child pornography.

Ernest Sydney Hulbert, who worked for the Health Department, was arrested in September as part of Operation Auxin, a nationwide crackdown on child pornography on the Internet.

Police seized four DVDs which contained 265,000 images of children believed to be as young as five engaged in a range of sexual activity.

District Court judge Alan Fenbury rejected a suggestion from a psychologist who had interviewed Hulbert that he had downloaded the images as part of a voyage of personal discovery.

After the sentence, investigating officer Detective Senior Constable Graeme Barry said the images were disgusting.

“I’ve been involved in quite a few of these cases over the last few years and in my opinion it’s one of the more severe cases I’ve dealt with in my time in dealing with child abuse,” he said.

Kalgoorlie teacher jailed over child porn

A former West Australian school teacher has been sentenced to one year in prison for child pornography offences.

Daniel Xavier Hogg was working at a Kalgoorlie primary school, in the state’s Goldfield’s, when he was arrested as part of an Australian Federal Police investigation in April.

In May, he pleaded guilty to seven counts of possessing child pornography and one count of using a carriage service to access the material.

In handing down her sentence in the District Court, Judge Julie Wager said Hogg’s career as a teacher had been ruined and he had undertaken voluntary counselling.

But she said accessing child pornography was a serious offence and would not be tolerated.

Hogg will be eligible for parole in six months.

Teacher admits guilt on child porn

A primary school teacher in Western Australia has pleaded guilty in the Kalgoorlie Magistrates Court to child pornography charges.

Daniel Xavier Hogg was arrested last month as a result of an investigation by the Online Child Exploitation Squad.

The 43-year-old is charged with using a carriage service for child pornography and possessing child pornography.

In court yesterday, the magistrate ordered Hogg to undergo a psychiatric and psychological assessment.

He is due back in the Kalgoorlie District Court for sentencing in July.
