Cameron Flynn Tully: Convicted ACT sex offender has four charges overturned

Convicted child sex offender Cameron Flynn Tully has successfully overturned four of 18 charges against him for crimes against young girls.

Tully, 41, was convicted by a jury two years ago of offences against eight victims.

He was sentenced to 14 years in jail, with nine years’ non-parole.

Most of the offences occurred at his family’s farm in Cook, primarily in the 1990s, where other families would gather for church meetings.

Tully argued in his appeal that the trial judge should not have let evidence for each charge be used as tendency evidence for the other charges.

He said the volume and complexity of the evidence was likely to overwhelm the jury and lead to prejudice.

During the appeal he also told the court the victims had colluded, concocting and contaminating evidence.

Tully always maintained his innocence.

In its findings, the court of appeal noted directions given by the judge in relation to what the prosecution had to prove in relation to one of the victims, may have been misunderstood.

Four out of the six charges laid in relation to that victim have now been struck out, but all of the other charges have been upheld.

Tully is to be re-sentenced on the remaining charges later this year.

Tully has been granted leave to appeal his conviction. It is un-known when the appeal with be heard.

 

UPDATED: NOVEMBER 2014

Tully will seek to have the convictions quashed. The appeal has been listed for directions next month and will not be heard until next year.

Canberra man Cameron Flynn Tully has been sentenced to 14 years jail for child sex offences.

Tully, 40, was found guilty of 18 counts of sexual assault, ranging from rape to acts on indecency, on eight victims, after a trial in June.

The crimes were committed against young girls who attended his family’s home church in Canberra in the 1990s and early 2000s.

Tully will be eligible for parole after nine years.

There was an angry scene when Cameron Flynn Tully was found guilty in the ACT Supreme Court of molesting eight young girls in the 1990s and early 2000s.

Tully, 40, was charged with offences ranging from rape to acts of indecency.

The jury found him guilty of 18 charges, not guilty of one and could not reach a verdict in another.

There was a heavy security presence in the court as victims and their families sat alongside Tully’s family in the public gallery to hear the verdict.

When the judge left the bench, the two groups clashed briefly in an angry verbal exchange.

The jury had taken nearly three days to reach its decision.

The two-week trial had included evidence from the victims and their families.

Many of the incidents happened at Tully’s family farm at Cook, where he would mind the children of people attending meetings including home church.

One victim gave a harrowing account of being raped as a six-year-old.

“I wish none of this had ever happened to me,” she told the court.

“I was so young, I was my daughter’s age.”

Another told of how she felt pressured to do what Tully told her, when he asked her to enter his bedroom.

“You never disobeyed a Tully,” she said.

“You just had to do what they said.”

And another girl told the court Tully had lured her into a room to see a kitten.

Tully denied the claims against him.

“I never sexually assaulted anybody,” he told the court.

“I certainly never let anyone in my room who wasn’t my own age.”

He also told the court he denied the suggestion he had been in charge of the children.

“I had no role in management of children… other than being one of the older children.”

But the jury disagreed.

Tully’s wife sobbed as each of the guilty verdicts were read.

He told her as he left the court in handcuffs not to cry, but to be strong.

Tully will be sentenced in September.

Child sex accused allowed to return to farm

A man accused of sexual assaulting four young girls between 11 and 23 years ago, is to be allowed to return to his Canberra farm to prepare for the bushfire season.

Cameron Flynn Tully, 37, is facing 12 charges including acts of indecency against the four girls.

Tully has been on strict bail conditions and unable to return to his Cook home, where his wife and five children live, since he was charged.

Yesterday his wife told the Kathleen Tully told the ACT Magistrates Court the allegations were malicious, vile, disgusting lies.

She told the court Tully had told her of the allegations when they were first dating, but she had never had a concern about him.

Tully told the court slashing grass on the property was necessary to protect the whole area from fire.

He will be allowed to return to the farm between strict hours, provided he not approach any of the other six homes on the property other than his own.

He is also not allowed to be in the presence of a child without another adult present.

          I do not know who you are, but perhaps you can understand that we all make mistakes and do wrong things, especially when we are young and confused. If there is no hope for redemption and forgiveness in your heart then I am sorry for you, for mercy, understanding and forgiveness are the foundations of strength. I regret not having been around to protect Cameron from falling into the evil into which he fell. It appears that you are pure and perfect, and able to stand in such judgement over another, casting stones.

    Brooke – I am not casting stones; a jury of 12 people from the community came to the decision ‘beyond reasonable doubt’ that Cammie was indeed a sick perverted pedophile. He did not make ‘mistakes’ as you state; Cammie intentionally and systematically preyed on vulnerable children and young people. And, for the record, there were more that eight victims – I hope the others come forward in the future.
    I do not have an ounce of redemption and forgiveness in my heart, particularly given I know the harm the complainants suffered at that monster’s hands.
    I am far from perfect, however I am not in the habit of kiddie fiddling – that’s Cammie’s gig.

      Noi dude, don’t talk bullshits here, Cam is a nice guy. How those juries without any legal knowledge can determine any cases that was based on those 90’s evidence? The evidence would be so weak, mainly about what she said and he said. However, if there was a case and police laid the charges, the DPP would say the case was viewed by various top judges and top DPPs to the jury, and then jury at that time would put their brains to convict the defender rather than free the defender. And it is really hard for the defender to win those charges because how to prove the defender not guilty is almost impossible.

        Joe ‘dude’ – I wasn’t talking ‘bullshits’ as you stated; are you are a qualified barrister now, or perhaps a QC?? You may need to get some of your terminology correct before you start representing ‘defendants’ as opposed to ‘defenders’.
        Unfortunately, your argument doesn’t make sense, and simply demonstrates your complete ignorance and lack of understanding of the criminal justice system.
        Joe, you may think that Cam is a nice guy, however I don’t think the eight victims (and their families and friends) would agree with you.
        Maybe read up on the justice system a bit more before you start posting things as if you know how it works.
        Arrogant, ignorant people only serve to grind my gears.

    Update – ‘Cammie’ has been released on parole today in Canberra. Given his lack of accepting responsibility for his heinous actions, he will now place young and vulnerable children at risk.

    Cameron Tully is now out of jail and living in Canberra. He got released early on parole.
